Yes, you are right. Cases are assigned (not picked), which is done in order they were physically received at the center they are being assigned at. If PD is not current, case is put aside and next file is considered. Due to huge filings in July'07, resultant chaos, and shuffling cases around between centers before entering them in the system, if your file is way below in line (eventhough you deligently made sure to have it with USCIS on July 2, AND your PD is current), no one is going to look at your file, until your turn (in order of final data entry) reaches.
If I recall correctly, I saw many posts about people called to ask about their 485 case status. And many got response as NC is cleared, waiting to be assigned to a IO and/or waiting for visa number.
That is why I think when you are current, you are then have a chance to be assigned to an IO, and then be able to get a visa number. but it failed because it was ruled "out-of-order" and hence rejected ...
I dont know why it was ruled out of order ... maybe because it was attached to the defence spending bill so it was not the right place to put in this kind of amendment....
I hope that Yeas mean YES and Nay mean "NO" or I need to get my head examined

Most of the folks are missing the point about the prior years approval numbers. All the approvals from 2004 - 2008 are padded with huge visa number from FB spillover and the recapture provision of AC21. From this year onwards we have to live with the usual ~3K per country per category limit. This is the reason why Charles Oppenheim is predicting decade long wait for EB2 I/C and all EB3's. We continue to beat down Oppenheim claim with our own numbers, but he knows more about visa numbers than any one of us.
Let us dream about recapture being a panacea to the problem. There is only limited amount of visa's to be recaptured (~180K) even with that not all categories can become current. Also during that last recapture debates there where lots of suggestions to stagger the usage of recaptured visa over a long time frame like 5 yrs. Even with recapture, the date movement will not be rapid, but it will be remarkably better than what it is now.

Skilled, Legal Immigrants Tangled in Illegal Immigration Mess
The debate over what to do about the millions of illegal immigrants in this country has occupied much of the public mind share over the past year, including press coverage, demonstrations, and debate and legislation at all levels of government. Drowned out by all the noise over illegal immigration is an issue of critical importance to American industry and tens of thousands of hopeful would-be citizens: the legal immigration system for skilled workers is badly broken and in need of an overhaul.
Of the on-average 850,000 green cards doled out annually over the past decade, approximately 16% (140,000 / yr), are allocated to so-called �skilled workers� - nurses, engineers, medical researchers, and a variety of other professionals. They have at least a bachelor�s degree, typically in a technical discipline, and many have master�s degrees or doctorates and significant experience in their fields. These workers pay taxes and health insurance, are educated and law-abiding, and they contribute to their communities. Most importantly, they help drive economic growth by supplying critical skills to US industry in an increasingly competitive global market.
Contrary to what some alarmists will have you believe, these workers are not stealing American jobs. They are brought to the US by American-owned companies who can�t find sufficiently skilled US workers. The US Department of Labor (USDOL) requires the employer to prove that there are no suitably qualified US workers available before allowing the foreign worker to be hired. Skilled green card applicants are also not �cheap labor�. The employer is required by law to pay at least as much as they would pay a comparably qualified US worker. This wage is established by survey and audited by USDOL. Anti-immigration rhetoric simply does not hold up to scrutiny when compared with realities of the legal immigration process.
The green card process for skilled workers has traditionally taken 18-24 months. However, many current applicants are facing waits of 5 years or more due to bureaucratic bottlenecks at the Department of Labor, US Citizenship and Immigration Services, and even the FBI. Recent attempts to fix the legal green card process have become mired in politics over what to do about illegal immigrants. For example, a number of measures that would have helped US corporations sponsor legal green card applicants were included in the Comprehensive Immigration Reform Act (CIRA) of 2006. However, after passing in the Senate last year, this bill ground to a halt in the House because it provided a path to citizenship for illegal aliens, a measure strongly opposed by many US Representatives.
Legal green card applicants are hopeful that Comprehensive Immigration Reform will be re-visited in 2007 and get a much warmer reception now that the US House of Representatives is controlled by the Democrats. Measures in the bill introduced last year would help to restore the green card process back to traditional 18-24 month wait times, allowing immigrants to get on with their lives and integrate fully with the US workforce in a timely fashion. I had similar issue for my spouse on H4. Was out of license for about a month... It would be a good issue to be brought up at Sep 18 Rally and added to core issues handled by IV in general. Lots of future immigrants are facing this.. But we need a collective voice as usual with any immigrant issue to get a resolution.. More and more states are joining to make Driver License as your "Immigration Status Document" causing "LEGAL to work but NOT LEGAL to drive" situation....

US economy is designed this way, everyone will get their own share. No one bothers about optimizing the chain and reducing the cost. If they do that whole economy will collapse. Hi,
I have my I-140 (approved in May 07) approved from my previous employer. I am not sure whether he has revoked it or not. I am now working as full time employee with another company. How can i find out if my I-140 was revoked or not? I am yet to file a New PERM, i already got a PERM denial after joining this new employer :( looks like i have to file one more... This looks like a infinte loop :(

You can subscribe to CRIS email for status updates. But sometimes you may not get the email. The letter may directly go to your ex employer's Attorney.
Even if you get a NOID, it may go to your ex employer's Attorney. We all know this employer attorney nexus - they are ready to screw you.
