i do wonder if the poll results from earlier polls if used to compare with the current one would help get an idea of the trend - kind of overlaying the snapshots in different points in time and then determining what the situation was and what is and then extrapolating based on data that is already known/ published by uscis applied to the trend. question is if we have the poll data from earlier polls?
good idea. A google search beings up:
http://immigrationvoice.org/forum/forum2-retrogression-priority-dates-and-visa-bulletins/6128-trying-to-find-where-eb2-india-might-land.html
almost the same sized sample (~450)... this was right before the july 2007 fiasco, but includes 485 not-yet-filed, so is in essence the same thing as this poll.
2003 got somewhat cleaned up (used to be 15% is now 1%)
2004 is more or less same, of slightly higher (98 votes (24%) now. was 84 votes(20%) then)
so looks like big improvement in 2003, but 2004 barely changed overall?

Wow you have REALLY stretched ur freedom of speech to the MAX here havent u ;)?
Haha!! I hope you are not offended - I apologize if you are.
Anyway - like I was saying freedom of speech and expression is very important for people belonging to any culture / country. Some people might think business / technology alone will ensure properity for the people involved - but the important thing to remember is that - business / technology is also a by product of these freedoms. When your mind is unrestricted by limitations and regulations - you get more innovative ideas - and you can also spread them easily.
Donot let your cultural / religious commitments hold you back - most of them are unfounded and lack evidence anyways. This is one of the reasons West is more progressive than East - because they lean more toward reason instead of tradition etc., - and they say it out loud also which we don't do. This enables them to get the bullS*it out of the way first and concentrate on constructive things - innovate, do business blah blah blah!!
Did'nt want to preach - but this is something that I value a lot.

As this issue has been going on for some time I decided to add my two cents for whatever it is worth.
It is important not just to note the content of a posting but also its tone. People in this forum are smart enought to determine whether a posting contain constructive criticism or is just accusatory. I think it is better to leave the accusatory ones to die a natural death while replying to constructive posts even when they are heavily critical.
Another thing to note is that everyone has their own peculiar situation. It may quite work out that only some issues may be solved by the legislation and it may not work to a person's advantage. Even then the people who are actively involved should make the call about what to pursue and what not to. The subtle nuances of the behind the scene politics is not visible to us sitting on the outside and I personally wouldn't like insider details aired on this public forum as this would provide the opposition with ammunition. I may be a bit conceited in thinking that discussions in this forum are being watched by the opposition but I am sure that that is happening.
Meanwhile good luck to everybody and my sincere appreciation to the core IV volunteers who it appears have significant understanding of how the political game is being played.

Is there any information on what an "easy" case is?
I haven't seen one so far!
It appears, easy case is a subjective decision made by a USCIS worker based on amount of time needed for the case.
It is a job scheduler that schedules the shortest job first with a subjective estimate of the time needed to process the case.

Let me guess, you are a pakistani terrorist. Now you are jealous that how come an Indian muslim win 2 oscars? How will you give out your hateful message to other pakistanis terrorists that indian muslims are being torchured, so you have to "save" indian muslims. Too bad, no pakistani got an oscar. I know why, because the terror capital of the world is going down the drain pretty fast.

Here are my thoughts/suggestions:
Its good to know what other people are doing.. but when the decision time comes only ur personal things that matters
Ask your self questions like some of the below:
1) how long u are planning to stay in house/US - based on this u can use rent vs Buy calculators to see which option is better for you.
2) is ur monthly income (Net .. not gross) is enough to buy the house u want? - means house in good location, with minimum sqft, enough rooms etc
3) is this right time for you or r u just want to take advantage of 8000/- pay back - if so please think twice - you can save or get back this money by other means if you carefully plan. Just see if you are better off purchasing house next year.
4) if the house purchased, will you able to fund any future investments?
many more personal things to consider...
so THINK ,... THINK, and again THINK before jumping on this HUGE investment.

Here is the timeline for folks that are not serious
EB2 India: Waiting for July - October spillovers thinking that most EB2 will be current. The prediction threads have hyped this a lot. Many will benefit this year. But many will miss this bus too. Some from those who will miss this bus, would be back wanting to do something in Nov - May timeframe. Others will waste their time on predictions and trackers and make those site owners rich.
EB3 India: Many who filed in July 2007 are still happy with EAD status. They worry and contact IV only if their I140 is revoked, I485 denied or if EAD renewal is delayed. Some still sulk or want to blame someone (even IV) for their delays. Those who have not filed I485 yet are few in number. Many new Eb3s still do not know the extent of the backlogs. With time they will slowly learn about the backlogs and wait times. When they suffer due to lack of EAD, they will all make noise on IV asking for some action. This is the reason why the I485 filing action item thread is still weak and pre-mature. I would give another 2 years for the non-I485 folks to have retrogression sink in.
Retrogression is not going away. If it goes away, only applicants will benefit from it. And these applicants are too weak and small in number to even raise their voice. So why would anyone pass a law to make these people happy that do not even want any law changed. After 2 years all the folks who are not participating in advocacy days and contributing, will contribute to IV. At that time, if we in core are still around, would rather ask them to lead the effort if they can and if they are really serious. The current advocacy day campaign and contributions are a measure of seriousness for us to plan our next agenda items.
Agree with Pappu.
We maybe happy now with EAD, but, we never know. Consider this, as per Yates memo
This memo is just a "interim guidance" and NOT a law. That does not make me very comfy. If it is a law, we can always appeal in court. Not sure about an "interim guidance "
It also clearly mentions, "this is an interm guidance and the final law can be more restrictive".
In the Yates memo, the 180 day rule is very Lenient , which many of us interpreted or will interpret in our favor.

In EAD form, they are asking about previous EAD info..like which service center, what date, GRANTED or REJECTEd etc.. Now I had two EADs..one is OPT and other one I got last year. Do I have to write info for both one or just for last year?? In last year's form, I wrote info about my OPT. But what now?
1. Paper filing mention your last EAD
2. eFiling mention your last EAD and there is also a space for two previous EAD, you will have to fill in that too.

United States Of America or more commonly the US means one and only one thing for most people in India, the land of opportunities, a place where every dream comes true, a Cinderella fantasy that pops t life. Well, Legend has it that once upon a long long time, it used to be true. But the current situation is a whole lot different than the legends and the fantasies. Lets delve into the story of an Indian guy, who set out on a journey in pursuit of his
dreams that promised him the sky.
This guy was a smart, hard working software engineer in his own power, working for a software company in India. He worked on different kinds of projects for different clients, all of which were from the fantasy land. The clients always appreciated his work and he had a great rapport with these people.
One day, he got an invitation from one of these demigods, Will you please come and join us and share our fortunes? We are in much need of someone talented like you to run our operations.
Now, that was an offer he could not refuse, could he? Its something he had been dreaming about, since he was a child. It seemed like an offer that would change his life for the better, in every possible way.
He immediately packed his bags, bade good bye to his family and friends, not knowing the future, not knowing he would not see them for at least a few years. It did not even remotely occur to any one at that point, that he will be tangled in so many restrictions, that it would be hard for him to leave the fantasy land. Well, who cares He is going to AMERICA!
He landed here, worked harder than ever, slogged like anything and proved his capabilities and reserved a place for himself in this wonderful land. Five years passed by..not realizing that every day has been the same, just struggling to keep up with the expectations of his boss. However he became a much respected person at his work place, every one who worked with him was very happy to have him here. They just loved his dedication and passion. His initial plan was to stay here for the 6 years he had on his H1-B visa and head home. But, destiny had something else in store for him. His employers wanted him to stay. They realized they would not be able to find another person of his caliber. So they started a process called Green Card which would allow him to stay in this country and work for them.
He went to India after a long time, and met his parents. They wanted him to get married; he met a nice girl of his parents choice. Both of them liked each other and got married.
She flew to the fantasy land with him and they live happily ever after.
Well, not exactly!
There is a twist in this story.
We need to talk about the girl for a little while now. She too was a young, aspiring software engineer with a good company in India. She was a smart and independent girl who loved to live her life. She lived at a short distance from her parents and family with whom she was very close. When she met the guy, she was overjoyed. She instantly liked him, but was a little apprehensive about quitting her job. But everyone told her that she was being silly and that she would get a job in USA, any time she wanted, because of her VAST two year experience. She believed it! The guy also did not know that his fantasy land had changed a lot since his going there. He thought that he was going to get his green card soon and that his wife would be able to work immediately.
So with all these hopes, they flew back to US of A. Here the reality was far from anything that she ever heard in the legends. She had no friends, no family, and no job. She was not allowed to work while she was on her dependent visa called H4. The hopes of green card were thrashed to the ground. Apparently only a small number of people were given these magical passes called green cards every year. And the wait was a very very long one; reality hit hard, it would take at least five more years to get their green card and that she would have to wait for an indefinite period of time before she could work again.
She thought of keeping herself occupied by making friends but she found none in her locality.
She wanted to put her technical expertise to good use by volunteering, she got a few offers but they were all so distant from her house. She did not have a car of her own, so she could not take up such jobs.
She was left alone at home all day, destined to look at the windows and the walls of her apartment. She could not take it. She applied for her own H1-B visa which she thought would allow her to start working. She had high hopes and started concentrating on honing her skills. But the process was such a long one that it took more than 8 months for her to get the visa approval. She tried to keep her cool, but it was one heck of a struggle. There were so many laws and rules and other incomprehensible things associated with her H1 and her husbands green card process that she could not go to India to meet her parents . The real struggle started once she got her H1 B. She could not find a project to work on. There were requirements for people in her technology, but most of the jobs required hat she be one of the following:
1. Candidate with 6 years or more experience
2. Green Card holder with any experience.
She hit a roadblock. 6 years of experience or GREENCARD????
How will she get any of this now?
Her husband had also become very sad because of the pain that she had been going through. They were never peaceful during these past 1.5 years. Even he was also completely stalled in his career. There is a rule which doesnt allow him to change jobs or take a promotion even in the same company once his green card process has been started. He has to either wait until he gets the green card or start it all over again. It is like leaving ones place in a long queue and having to join in at the end, all over again.
I hear they are thinking about going back to India, where their lives will be much easier.
Two highly skilled people who were disowned like foster children and put entangled in such complex problems.
Unless they do something about this green card process soon, there will be many more immigrants who would plan to move back to their own countries.
It is Americas loss, no doubt!
An organization called Immigration Voice has been started by a few people, suffering skilled immigrants themselves, to take up the cause of all the others in similar situation. It has picked up quite a lot of momentum these days and
had been able to achieve success to a certain extent. But it requires more people, more funds and more support to actually attain a significant result.
America has been built on the competitiveness of highly skilled immigrants. America enjoys a technological leadership around the world primarily because of them.
Lets hope that the government will do something soon to provide relief to these skilled immigrants lest America should become a mere legend like Atlantis.

wait, Franklin,
1. Did you get already your GC approved?
Yes
2. I think you DO need PD to be current for GC approval. In best case scenario, GC could be approved in matter of 10-15 days, so for July filers there were some GC numbers available, and few lucky ones got their approvals. This is how I see it... please correct me if I'm wrong.
I thought the same too, and I think it was the incredibly rare exception - I must have been assigned a visa number VERY quickly and probably benefited from the confusion at the agencies in the summer. AOS applied early June, FP was completed early July, and I am lucky to have a pretty unusual name. My PD was April 04, my card was received before the DC rally - Visa Bulletin for my category was Aug 02 at the time of approval... .
3. It would be interesting if shimul99 would share with us as when exactly his status was adjudicated. I've read somewhere that there are cases, that people got their GCs approved by mistake and lawyers suggested to inform CIS and return the GC. These people were then having their statuses adjudicated when their PDs were becoming current.
Sorry - I missed these questions...
The system is unfair and broken. Just because I benefited from the current system, doesn't make that statement false

just becoz u'r kid is not good in spellings.... it doesn't make it mandatory for some folks to be jealous in demeaning way...... maybe you feel bad that a 10 year old has better english vocabulary than you at 40..... whatever it is.... u'r not always in competition with u'r surroundings........ grow up and appreciate the effort & dedication that breaks human limits..... even if it is a 10 or 12 yr old.....
software can write software too...... then y do we need programmers.... y do we need eb2 and eb3?
y do we have 100m race if we have cars? y do we have swimming contest if we have boats & ships that can go lot faster....
have an appreciation for things around u..... just becoz u'r not good at something..... or just becoz u don't think its important to u..... it doesn't mean that it doesn't have any meaning...... there is lot more to this competition that meets the eye..... u'll value it only if you open u'r eyes and make an effort to see.....

Thanks for your reply.
I really dont care what my company policy says because as I look at it, it should be my decision whether to work on EAD or continue on H1-B. If they switch my work authorization without my knowledge, then it will be a classic case for lawsuit. Moreoever the policy is not documented anywhere.
As long as you dont use your EAD, you can continue working on H1B.
In fact, if it is the same employer as your GC sponsor, you dont have to do anything.
The thing to remember is to extend your H1B if you do a H1B transfer so you dont have any issues at the time of transfer.
All this is assuming that your company policy can handle exceptions to the policy :)
Thanks!
