    i was thinking...

    500000 legal immigrants, even if u assume 4 per family , ONLY 125000 houses can be sold...(even if 50% qualify for a loan.. thats just 62500 houses sold.. last i read..there were millions of homes for sale)

    This is my thought process (also referred by Ron G):


    July 2007 brought in approximately 500K 485 cases.

    We do not know how many cases were pending as of June 2007.

    Fiscal year 2007-2008 USCIS used over 140K EB VISA numbers (I think it was around 155K).
    Fiscal year 2008-2009 USCIS will use atleast 140K EB VISA numbers

    so, 500K - 300K = 200K.

    Assuming USICS approval rate is 85%; 75K of 500K are denied.

    200K - 75K = 125K EB cases pending from the July 2007 cases.

    Additions: from all current categories - may be 25 K in 2 years?

    So, 150 K plus whatever that was pending as of June 2007.

    So next fiscal year, 2009 if USCIS uses the quota 140 K, most or all of the 2007 filings will be cleared. If not EB3 I, definitely EB2 I and C, EB3 ROW will be cleared.

    Depending on new filings, EB3 I might retrogress but retrogression might come within 3-4 years instead of current 8 years.

    I strongly believe, beginning Jan 2010, dates for EB2 (I and C) will move forward heaps and bounds followed by EB3 ROW.

    Good analysis.

    This is the key stat here. It all depends on how many apps that are in the current category now get filed in the next few years. If there are no more new EB applicants, we should see all pending apps to get approved in a year or two max. The 4 current categories now are EB1 ROW, EB1 India/China and EB2 ROW. If there are 140K apps coming in every year from these categories, we'll never see any movement for EB2/EB3. Anybody know the average number of applicants the last few years from these categories? From the recent news, we know that demand for EB1 India and EB1 China has grown substantially. In my opinion, setting a cutoff date for EB1 India/China would be the best thing for USCIS to do now. That will prevent any new visa usage for EB1 India/China and allow EB2 and EB3 categories to catch up.

    you should possibly also carry a copy of the AP application. At least my application clearly stated that travel was for business/personal reasons...

    I am sorry you had a bad experience...possibly because of the officer's ignorance...worth a complaint...maybe you can draft something with your lawyer....don't just ignore such bad behavior...

    I have travelled on AP and didn't have any problems..although the officer stamped a wrong date (one day earlier) on my passport..talk about incompetence

    Can someone tell that If USCIS says that 29 June 07 is the last date to receive applications for premium processing for I 140 . Does that mean that they shud receive the application by 29th or application shud be post-marked dated 29th in order to be considered for premium processing.

    We mailed my wife's PP on the 29th. I spoke to the customer service rep at USCIS and he said post mark date is what they see. But I have been seeing other websites say that its got to be received. Thats doesnt sound logical. So wait and watch I guess.

    I filed I-40 on June,1th 2007. My lawyer will file my I-485 & I-765 by July 1st. I'm currently on F1- status , When i can start working? do i get an authorization to work before approval of the I-40?

    I'm sorry but does anyone know the difference between EB3 and schedual A? I'm an RN and i was filed under EB3!

    The reason why most people end up with such situations is that the employers don’t file for H1 extensions on time. Though the law allows filing of H1 extensions upto 6 months before its expiry, most employers file for extensions only at the last moment. It’s advisable to go for premium processing in such cases, so as to get the approvals on time.

    Firstly I am not from India where most of your guys come from. Instead from Taiwan 2 and half year ago. As travelled much between Asia countrys, no much time staying is US office although I based here. Yes, my English is poor and broken but this is not a fake story, make no sense for me.     No need to upset. This is a different type of question. I googled and researched on it for hours, how to suggest you. In fact I did not know several words and acronyms used here.

    This is a situation because of cross-cultural differences, ignorence of law of land, weaker knowledge of English, etc. It might not have been aggrivated, had you been in your native country.

    Once in Japan, I crossed rails to go to next platform and caught by police for doing so. I explained them my childhood, when every day I used to do so in small town and it was OK there. Police told me that they understand me, and asked me not to repeat again there.

    My son asked for Samurai. On airport, the moment police saw it, they snatched it from me. They kept it under their possession and handed over to airlines to give me back at destination.

    I feel that police and people are considerate to situation.

    So, based on my experience of sevaral such things happening due to ignorance and past habits:
    .... Use translater and explain in native language (You can say that you know technical language to work in office, but don't know day-to-day language. You don't know difference between drag, pull, take along, etc).
    .... If you have any cultural example, explaining up to what level it is acceptable in your society.

    You must understand that under law of land, the way happening has been explained to police is serious offence. So work around explanation based on language gap, cultural gap, traditions gaps, etc. to minimize its impact. Show your preparedness to accept bridging of gaps to meet the law of land.

    teddy the pun "multi-national managers(via L1A)" was intended. if that makes it clear.

    anyway, the focus of this thread was about the president's immigration speech. Atleast the speech included the fact that illegal immigration makes a mockery of legal immigration. understood that any solution also must include finding a way on how to handle the undocumented people.

    anyway, the speech for now might be just a start or more "kick in the butt" to let the congress know that they need to start work in CIR. when it comes to fruition is anybody's guess.

    Hello Guys,
    I need your advice here. Six month ago i joined one of the many blood suckers -Desi cosulting company in new jersey. As you all know, they ask me to sign their contract in which its mention that if i leave their company before 1 year then i need to pay them 15k. Thy also charge me 3k for my H1-B which i am still paying everymonth from my paycheck and we have 70/30. In just six months i am so much fed up with them. These people are so rude...always show their arrogance over phone. I have no libarity to find job by myself. They always looking for higher pay rate sp that their big money tummy get filled up.and i also feel that they didnt told me the right pay rate for the project i am working on right now.


    I really want to leave them, Even before 12 months. Is there any importance of that contract letter i signed with them?. Can they Sue me? What are my options? Please suggest me.....i am in stress.

    Follow these steps.

    I assume you have proof that you paid for H1B expenses.

    Silently transfer your H1 to a new employer.( Your current employer won't even know that)
    If they threaten you with the contract, tell them you will report them to DOL.
    It is illegal for employer to ask money for H1B expenses.

    There are no bills being discussed. House as well as senate are on recess and will convine after Sept 10th. After it reconvenes, between 10th sept and Oct 8th - it has a lot of tasks at hand, and no apetite for any big and controversial issues like immigration. Mid term elections are in early nov and nobody wants controversial bills debated just before that. Morover it has been made clear that GOP does not want any immigration bills except "fencing the border". Democrats do not have required votes for cloture.

    So, nothing is going to happen on the immigration front- legislatively untill after nov elections. Attitudes towards this issue will change and more GOP Lawmakers wil favor talking about this after. It will be a different ball-game depending on who keeps the majority. In the lame-duck there might be a chance.

    August/Labor Day Recess
    House - August 9 � September 12
    Senate August 9 � September 10


    Target Adjournment:
    House - October 8
    Senate - TBD



    So, between now and the lame-duck session, if we can educate lawmakers- especially now- since they are comming back home and to their constituents in the recess. Most of them have town-hall meetings arranged and want to hear from their constituents. It will be good to make ourselves visible and heard.

    I guess you are speaking like Tom Peters. But in the end, it all depends on where one wants to be and what is the world view of someone. If one thinks that just because someone is a manager over others, that makes that someone better and more successful than others, and if most B- students manage A+ students (which is fuzzy maths), yes, in that case it maybe that its better to get a B- grade than A+, and there is no need to go to business school either. If the world view and the objective is not just to become a manager or make 100K instead of 120K, but actually do something worthwhile in every stage of your life, rather than just having an objective of becoming a manager, maybe its about learning a language and words, then why not. Strong vocabulary is the first stage to clear expression and clear expression is the corner stone of a successful and satisfying career, including bring a manager. I don't see anything wrong with learning more words, or loving parents or obedient children. Everyone has a different age in their life when we revolt against the environment, just to break free. Its not necessary that one must continue to revolt an entire lifetime to be creative or be better than others. Bill Gates or Steve jobs never wanted to become just managers, they wanted to re-invent the future. College dropouts, but successful. But how many Gates and Jobs do we have? I guess there is no clear definition of success and different people gauge success differently, but most people, more so in this crowd on this forum, relate success to level of education/university (US masters or Bachelors from India), and title at work place. But maybe the key is not how others gauge your success, but how you gauge yourself. Maybe you have set your eyes on squeezing most number of lemons or maybe being fastest eater of a water melon, or climbing on top of rhinoceros back, whatever it is, if you have done it and you feel satisfied, you will see yourself as successful. So whatever is the definition of success, whatever is anybody's opinion or world-view, the fact is, these kids did well with the goal they had set for themselves. And if that is how they feel satisfied with their hard work, they are successful. The fact that there were so many other contestants wanting to prove that they were better than others, and they weren't, makes it a recognizable achievement. Its that simple.
