That doesn't contradict anything I said. I was referring to the 38 occupations where you do not need Canadian work experience. I agree that the list is much more restrictive than before. The other way around it is to have a job offer. All I said was that Canadian work/student experience is not mandatory.
I get it....they will keep tweaking it...if too many start applying with the HRDC approved job offer then they will crack down on that.
It happened to H1B to EB2/3 GC thing as well. In early days people even with MS could get Eb1 till there was court case after which
the requirements were tightened.
Now with PERM even EB2 is becoming harder.
The problem is that more people want green card than what the govt wants to give. So they try to come up with filtering criteria
in a varierty of ways...tightening the rules, country quota (in case of US). visa post processing quota in case of Canada etc.

You can't generalize. If your kids are smart they can get into better colleges like IITs etc. I think you are confusing the issue about adaptability with good future prospects.
Wait a second. If you are not adaptable to the new environment, it becomes a rat race.If the situation is not conducive, your smartness aint gonna help. I think thats what the OP clearly meant. Its not easy for a kid who is in 8th grade in US to snugly fit into Indian System. Coming to the IIT's, Have you ever compared the total number of seats available in IIT's to the accepted numbers from IVY leagues and other big schools. In India, you have to be the best among the best to get into IIT's. You have to be best here and oh yeah.. You dont have to lose some of the smartness to reservations. But I agree with you that parents should let children pursue their own interests rather than thinking about him/her being a doc/eng.
What is your point? Madhuri just said that when kids are 8-9 years old it is easier for them to adapt to the canadian system rather than the indian system. No one said that the indian system is not up to the standard.
Having studied in every single indian board system, state, cbse and icse along with primary education the london board (o/a level), I have some experience with regards to adaptability-> It sucks. I have a abcd friend who moved from US to india while in the 6th grade and she regrets those two years of her life. If you have kids in school over here please think 3 times before u shuttle them back and forth.

"Depending upon where you are from, your home consulate may (most likely will) accept an application for consular immigrant visa processing. Go to the main ImmInfo.com site and read the article and other materials on "AC I-140" processing. Use the search feature if you can't otherwise find these materials.
You DO NOT have to abandon your AOS. It can continue while you pursue a consular application at the same time. When you get your green card via consular processing and return to the US, you can withdraw your AOS application at that time. Until then, it stays on file. You may use your AP and EAD while you are doing this.
We have process more than a thousand cases via this procedure. It is nothing exotic. Indeed, a substantial number of people who still visit this forum are former clients of ours who did this exact same procedure."

Since, last august DOL has become weird with even approving eb3 labors. Generally, attornies will put language in the eta 9089 that they will accept three years of experience for each year of bachelors degree missing (this is in line with education evaluators and uscis).
These days USCIS is trying to stick to the rules, so all people who are trying to beat the system by using wrong credentials are getting stuck. Lawyers have nothing to lose, they will make more money from you.....one from your eb3 application and two from your high risk eb2 application which will eventually be rejected.

I wish they hadn't closed the blog, I wanted to post on there. I don't see any posts on the link you have provided for the H2B blog on WSJ. Am I looking in the right place?
No one commented at this H2B blog. This blog appeared without an article as compared to the other which had an article + a blog. BTW, WSJ has more articles on H2B then on EB GC issues.
Some blogs come and go like immigration bills on the Hill. Have writeups for all occasions.
Mercury News blog (http://www.mercurynews.com/politics/ci_7091661#recent_comm) is still open. Blog your issues/opinions; needs account. Keep in mind that Mercury News has published EB GC articles but more articles won't hurt!

Why not? Although I have applied for GC, I have no desire to take US citizenship, just to let you know. The majority does not mean the whole world and also does not mean everyone. There are Indian citizens that love India. Parents should be able to make decisions for their kids until they are 18. The kid can take US citizenship when he is 18 if parents have opted for Indian citizenship.
On a different angle, I would like to take US citizenship and I am actually waiting for it. Again, event this doesn't mean that I want to live here forever :D. I just want the convenience of coming here and working here as long as I want to, then pack the bag and go back to India to enjoy rest of of my life... I don't see that part of the life here.. :D

I think you are wrong... Company A can revoke approved I-140, if employee leaves them..
No problem my friend. You are welcome. I am glad I was able to help you.
Company A CANNOT revoke approved I-140. I have checked this with 3 to 4 attorneys & also with Gurus on this forum. Only the USCIS has the authority to cancel the approved I-140, if it detects that it was obtained fraudulently.
One more suggestion, ask company B to file your H1 with Premium processing. Once you get H1 approval then submit resignation to Company A.
Enjoy the party Bud. Have a drink on me!:p;). Wishing You and Yours Happy New Year.
If you will be benefited by I-485 filing without current priority Date, please vote YES on the Poll.
Then please send an email to ivcoordinator@gmail.com with subject - "I485 filing without current PD - Impacted Member". There will be no movement in May bulletin, but June bulletin will be Jan 1 2006 for EB2. I'm guessing this based on last 3 years, where there was no movement in May but had significant jump every June.
What is the purpose of this guess work, or non-scientific predicting? Just wait and see, what happens? Favourable speculation is not going to generate real good bulletin.

EVEN THOUGH WE WILL NOT SAY IT
FIRST UK and now the US
UK kicked out Indian doctors. They also implemented laws which make it difficult for the resident Indians in the UK to marry in India and get their spouses in.
Now its the USA - THEY wont be far behind. Australia will ofcourse follow suit.
PATTERN - WHITE & ANTI SEMITISM
THEY WANT SLAVES WHY CAN WORK FOR THEM FOR FREE. THEY WANT TO PORTRAY THEMSELVES AS ANGELS TO THE BROWN MAN WHICH THEY ARE NOT. Modus Operandi - Spoil the current scene more than it is currently spoiled hence the current situation will look good. Though the current scene is just as bad as can be.
THEY THESE HYPOCRITES GO ONTO THE TV AND BARK
WE ARE A MULTICULTURAL SOCIETY (Read Brits & Europeans all White)
WE ARE AN IMMIGRANT NATION (Yeah right what VISA did the Europeans have when they launched GENOCIDE against the NATIVE AMERICANS)
WE ARE EQUAL OPPURTUNITY EMPLOYERS (READ PREFER WHITE ONLY IN THE WORST CASE WHEN THE DUMBEST OF US CANT EVEN FIGURE OUT WHAT A SYNTAX IS DO WE MAKE A HALF HEARTED ATTEMPT TO HIRE A BROWN MAN). But BY THE WAY the farms need CHERRY PICKERS.
WE HAVE GIVEN SO MUCH TO THE DEVELOPING WORLD McDonalds, Coke & Pepsi (TAKEN MORE THE DEVELOPING WORLD SUCKED IT DRY)
IF THEY ARE JUST SO UPRIGHT ABOUT BEING WHITE WHY DO THEY USE ZERO it was DEVELOPED in INDIA. SHOULD HAVE A FUCKING PATENT on ZERO AND SHOULD GET ROYALTY on it for EVERY TIME A SENATOR APPOSING IMMIGRATION USES IT TO CALCULATE SOMETHING. IF ONE OF YOU IS READING "YOU HAVE NO RIGHT ON THE ZERO START USING THE ROMAN NUMERALS MR. SENATOR, THE ZERO IS INDIAN INTELLECTUAL PROPERTY"
PISSED AND MAD AS CAN BE.
IF THE BILL GOES AGAINST US I SWEAR ILL BOYCOTT ALL US MADE PRODUCTS OR EVEN IF THEY HOLD ANY EQUITY IN THE FIRM THAT SELLS ITS PRODUCTS IN INDIA.

[QUOTE=h1techSlave;231111]I have listened to a couple of speaches by Bernake in NPR. Basically that guy is completely in the blank on how to handle the economy. He simply says, we are in this mess, because the lenders were very lenient. Fed measures such as interest rate cut and pumping money into the banking system is causing the dollar to fall thus further weakening the economy.
Dude; not that your idea is bad, but dont come up with assumptions that the fed chairman is clueless!! He has been handling the crisis extremely satisfactorily. So far he has proved to be a good chairman and similar to Greenspan and Volker.
You have to understand derivatives and structured investment vehicles to understand what the economy is facing. The risk of sub prime CDO's has been spread thorough out the credit markets. Just imagine Bear Stearns which has a head quarters building in NYC worth $1 billion was sold for $236 Mil. Yankees pay A-Rod more than that. This will tell you how the valuation of derivatives has depleted cash flow and liquidity of a wall street titan which had stood through the great depression, 2 world wars, market crashes in the 1970's, 87, 01 and recessions in between.
Google "Long term Capital management (LTCM)" and study their history you will see what derivatives are capable of. Warren buffet calls derivatives "Financial instruments of mass destruction".
So the man is faced with such a mess, dont insult his intelligence by making unwarranted statements.

Hi
I am applying for AP (new). Are they issued with 1 year validity or 2 years ( now that EAD is being given for 2 years)?
I have not heard 2 year AP yet from USCIS. As far as EAD is concerned, we will start getting 2 year EAD from Jun 30.
There was some proposal of single EAD/AP card, but heard no progress on that.

Thanks for your message.
The issue at hand is not to "prove" if you are educationally qualified rather long delays in legal employment based immigration. So sending copies of degree certificates may not convey our message. Also, if we wrap the stoppers in the photo copies of the degrees that might show subtle disrespect to American learning institutions that gave you those degrees. On the contrary, these degrees are to be framed, if you want to. Lets not do that. We want to give a positive message e.g. stop reverse brain drain.
Stopper is a good idea because it weaves two ideas very effectively:
- Stop American jobs from off-shoring : use a stopper
- Stop reverse brain "drain" from America to keep America competitive : use stopper
This concept of reverse brain drain is well documented by the recent Kauffman foundation study http://www.kauffman.org/items.cfm?itemID=906
where they mention that 100K high skilled immigrants have left US to go back to India, China and other countries.
Totally agree and we will make people stop and think... "why stoppers"? and to finally start to differentiate us and our cause from that of illegals
