This H1B drama has really brought out the "indian" in each one of us (you). God Forbid, some of the anti-immigrant agencies see this, we will no face to fight.
To say something like what logiclife has said only brings out the true face of the some people behind immigrationvoice.org. It all boils down to "who has a US degree and who hasnt"..well, Mr logiclife, You dont know the value of a US degree simply because you dont have one! I want my GC as much as some people here without a US degree, but to classify a US degree as being the same as "warm spit" is just plain "uneducated". Now, I really appreciate all that immigrationvoice.org is doing for our community, but some of the these stupid racist comments from the so-called administartors,with such an attitude,who happen to meet the US lawmakers scares me a lot.
There are people who have done Masters in computer science in USA, graduated in 2002 and 2003 from top 50 universities and ended up getting training from desi bodyshops who we all love to hate. That training made them capable of gettting H1 and paycheck, not the books they read in US masters courses.
If US universities were up to the job of teaching people what was demanded by market, these folks wouldnt have had to go to desi bodyshops do get training.
I dont have US masters. I had enrolled in US masters degree in fall 2000. I left after 1 semester. During my brief stint as a student of Masters in Computer Science, I did get an opportunity to see what the courses are and what they really teach.
The reason I am lashing at some folks here is that some people are thinking that the Durbin-Grassley bill will benefit them because it will end consulting. Some people dont realize that most US masters degree holders, both MBA and MS (Computer science) find out that in order to get an H1, consulting is THE ONLY OPTION, especially when INTEL, Oracle and Cisco arent recruiting, they do go and stand in queue in front of consutling companies (Desi or otherwise). Also, people doing full-time jobs in silicon valley (what some people call "real jobs") also do fall back to consulting when they are laid off.
When employees of chipmaking and software development companies are laid off en masse, (and many of whom have masters degree from USA) where do they do to fall back and file H1 before the grace period expires?

To say that US masters degree holders dont need "Consulting" is the most stupid comment I have ever heard. Also, how important you are to this country or tech industry is to be decided by your boss and your employer. Not by what degrees you have in your resume. So by saying that "We have masters, we deserve better" isnt really going to jive with reality. People get masters degree mostly because its a stepping stone to H1B, just like H1B is the stepping stone to GC. Very few people do masters because they want to learn hi-tech stuff or to get better education.
My comment that you are criticizing was response to such post that said "Durbin Grassley bill is good for US degree holders because we really dont need consulting". Well, you very much do need consulting.
Also, I am seeing lots of grad students and masters degree holders happy about Durbin-Grassley bill. Some of them are under the impression that since they dont do consulting, its good for them since people doing consulting will be out of the queue and that loss will be their gain.

The letter was drafted on the 9th - so a response is due today. He may take his time to respond to Congress Woman letter by saying there are more pressing matter's on hand that, he has to deal with, including the word "gut feeling"

It's hard to get a good idea when so few people participate in the poll so I took the data available on and ran a few numbers.
I queried for EB3-ROW I485 pending applications (~700 applications) and copied/pasted the data to a spreadsheet: http://spreadsheets.google.com/pub?key=pivQbtGMEqKxBgHVI0_y4IQ
Here's a report with a PD distribution chart so you get a better idea on where we stand:

I have read that the Chicago cases were going to be moved to from May. BUt what about the cases that have been in Audit since Jan/Feb 2008. Were they also moved or something.

All of the Chicago cases have been transferred to Atlanta. If the Chicago guys want to talk to me, I�m happy to do so. They don�t have to hire me if all they want is information. As for putting names and case numbers, without that information, they won�t take the letter seriously. Also, I think that this will get the DOL to move on those cases. Almost every time I have made a specific complaint, they have responded by resolving the case right away in order to make the whole thing go away. The cut-off dates for the Employment Third and Third preference �Other Worker� categories were held and then retrogressed in an effort to bring demand within the average monthly usage targets and the overall annual numerical limits. Despite these efforts, the amount of demand received from Citizenship and Immigration Services Offices for adjustment of status cases with priority dates that were significantly earlier than the established cut-off dates remained extremely high. As a result, these annual limits have been reached and both categories have become �Unavailable.�
Visa availability in these categories will resume in October, the first month of the new fiscal year.
Looks like EB-3 will remain "U" till Oct 1st, 2009. The only good thing about this whole thing is that USCIS some how found and got hold of all those old cases with old PDs and are processing them now. So hopefully, the movement starting Oct 1st, if any, will only be a forward movement.

Please avoid posting any name of any consulting company on our forum either advertising their services or websites to find such companies. This is not a job board or area to list employers if you are unhappy with them. We have been deleting posts by members naming companies or websites to find consulting jobs. We have also had some anti immigrants on our site, fishing for such employers and to quote your posts and IV name in their lawmaker meetings and media materials. If you come across any such post, inform us.Thanks for understanding.

Gurus Pls help
I was with Company A whn I got married which had my visa and I 94 till Nov 08,2006. My wife wnt to consul. and got her visa and I-94 till same date.
I came back to US alone and changed to company B in July 06 and got my I-94 till 2009. Since my wife came to USA after that she didnt get her xtension.
i forgot to file for her xtension.
I had to agn change the company C in Dec 06. Thats whn i realised her I-94 expired in Nov. My lawyer said it shud be Ok since she has not passed 180 days after it has expired. or else she cud be black listed
Today lawyer got an email from USCIS saying they r waiting on security check on my wife. Wht r the options my wife has becos her 180 days will reach in May 08. Can she stay here till a decision on her is finalised by USCIS?

I dont know but even the smallest of consulting companies dont make this kind of mistake and they would remind you if you forget. My company's lawyer is quite lazy and slow but even his paralegal asked all the right questions and got all documents needed and didnt forget stuff when filing for various things.

If you indicated in your I - 140 that you want to do CP, NVC watches for PDs and when someones PD is about to be current they sent out (packet 3) which is the application packet to start CP. They send this sometimes 6 months before your PD is current.
That is it, if you turn around the application packet soon they will start processing until they are done, and wait for visa number.
You can swich from AOS to CP, but I am not sure about the procedures. There is good information on Ron Gotcher's forum about the CP process.

I arrived on Monday morning and met Paskal as he was going for meeting. Went to situation room and first met ever energetic gcs999. We went out for lunch with logiclife. And then start meeting people and I'll list them separately. Two of the most memorable days in my life. Thank you guys and gals.

Besides no one is going to listen to us unless we maintain a long term relationship with many lawmakers by meeting them regularly all across the country. only then will they listen to us as representatives of IV and introduce Bills like this and co-sponsor and vote for it. It also has to do with building relations and trust.
Thats the only way to get them to pass Bills for us.
This is a process that can take months of work to get a Bill introduced and get enough people to vote for it.
Just calling them at the last minute and saying 'lets push for this' or 'why is IV not acting' is not going to do much help without the previous step.
This is an ongoing process that needs to to be done over a long period and its about getting enough votes in house and senate 216+60 to pass. that is how we ensure close to 300 lawmakers will vote for our cause.

Our interview appointment came very quickly, within 3 weeks of the March visa bulletin. I wish you all the same fortune and hope that the priority dates open up considerably for you all.

However, since these people have some influence, I also wanted to discuss with them some of the more important issues facing skilled immigrants. I will mention the idea of meeting with more people in the future. I think it is important for them to be more in touch with those who are affected by immigration policies. My sense is that many of them don't understand the issues very well.

you cannot take one guy's response and generalize.
Majority of EB2 members understand the problems faced by EB3. They are willing to work together. However it must be something better than the status quo.
The strategies and solution presented must benefit vast majority of people rather than one specific group.
I am totally against any effort that undermines one group and favor's other.

You can use that labor. Here is how you would proceed.
Comply with the advt requirements and whatever else is pending - in couple of months you will have your old labor approved - once old labor is approved , just follow the process normally as you would do.
Since both labors were filed in same category , you dont need to do PD porting or anything. Life is pretty simple for you ( wrt PD porting ).

We need to find out if they cleared the easy cases first and gave them GCs instead of processing EADs. As per our latest information, USCIS had been going through the scanned notices. The NSC issue fix was already set in motion last week. It remains to be seen how soon NSC EAD cases are cleared. It will not be overnight, and may take some time, but we have to monitor the improvements in NSC.
