NKR & saralayar, you guys are stirring up Hornet's nest ... ppl will come up with loads of arguments from both sides of fence .. its best to not to change the diection of the citizenship discussion ..
That was exactly my point. I wanted him to concentrate on the discussion and not stray away from it.

I got my green card in the mail yesterday. Only 4 days after the 'Card Production' email.
It is great relief.
Thanks all of you for your valuable information. Good luck everyone.
why bother show up on IV now? I dont like ppl joining IV just to declare their GC status - no contribution.

I had similar situation recently. I tried calling CGI houston several times with the nos. listed on the website and no human would answer. If you are homesick, these nos are perfect to give a call. It would just play you a long Indian Classical music over and over again. My ears were still ringing with the music after the call, you can imagine how many times I had called!
Once I was lucky to get through, but not for much help. If anyone picks ups by chance, they would be rushing you like anything and refer you to consult the website.
It is amazing!
I mailed my passport about 3 weeks back to SFO. Have not yet got it. Anybody done it recently?

My interest in the house would be long term investment rather than quality of life. Another point is that most people are unwilling to spend lot of money on rents to get the same QOL. There is emotional element there called (eventual) 'ownership' but that's only emotional. That I don't care about too much.
If the trend indicates prices are falling this year, I guess people will wait for a year more but at some point people will go ahead, depending on the overall economy start buying because no one can really predict the bottom. At that point, it may even start going up allowing the economy to slowly get back on its feet.
The trend is certainly clear :(. That 'some point' is far far away and nearly invisible.

Oh !! I see then to approve for a 2001/2002/2003 485 case , every month USICS needs to make the VB current on 15 and take back to on 30 ....
Not necessarily that they have to make it current as the retrogression kicked in only @ 2005 Jan, so none with PD 2005 or later has their petition pending at this time at least in EB2/3 category. Also in 2004 there was not PERM and folks filed for Labor, except in certain states like Iowa, etc... Were waiting for labors somewhere between 6-10 months minimum. Mine took more than 2 years. So the I-485 petition pending, latest PD most likely could have PDs up to June/July 2004 for EB2/3 category. So if they set the cutoff date Dec 2003 or Jan/Jun 2004 they will have sufficient petitions that are already processed and ready for approval, If they do not want to loose the visa numbers. I dont understand the logic behind the VB, that visa availability showing current for all categories.. Had they bumped the Cut-Off date by 6 months at a time for each month or even a year, this might not have been so bad.

One more thing along the same lines, what will happen if my friend gets his H-1B through non-profit organization and will want to move to a profit organization? Will he have to again wait untill the regular quotas kick in? In other words can he simply transfer his H-1B to a profit organization at any time of the year regardless of the availability H-1B visas in the numbered-cap/quota system?
regards
I transferred from non-profit to profit. I have a US CS degree which has a separate H!B quota. I was not aware of all these issues at the time of transfer. So I don't know the category in which I was plugged.
I think it will be counted against the cap. It was discussed in some forum some time back.

She obviously cannot wait till Oct 1st or she won't get paid for the first week (at least). Contact the SSN office to find out how soon you have to file. In my opinion, you are eligible to get an SSN the moment you receive work authorization (even if its for a future date).
i will call them up and post my experience here.

Hi
My wife have H1B approved in 2005.Her stamping was refused on 226(g) section. She came to u.s.a on H4.Now her employer has applied for premium H4 to H1 transfer for her.
We didnot hear anything from them.It is already 2 weeks.
If it goes through.Does she need to go back for stamping to start working.
How the things will be?
How long the process will take (transfer)
If the attorney can help me in this,it is really great and appreicable
thanks

What is 226(g) section? Can you elaborate on why was H1 stamping denied even when you had H1 approval.

If they accept all 500k I-485 application. They will have more than 140k cases eligible for approval every year. I dont see any visas will get wasted.
I agree, i am afried that this is going to back fire and would let USCIS waste visa numbers and we all can continue our wait ever after. Nice job

It is mindblowing to see insensitive posts with regard to folks stuck at BEC.
IV core has stated repeatedly that the BEC issue is on its agenda. Thanks.
To those members who say that "life isn't fair so get over it": We are here at IV not to get used to unfairness, but to do something about it. I was stuck at BEC for many years. It is the most unpredictable of all GC stages; and those who didn't have to go through the BEC mess should consider themselves lucky. Cases can drag on for years; cases get closed arbitrarily; and there is hardly any way to communicate with the BECs. Try to understand the difficulties of those stuck at BECs instead of trying to make fun of them.

The objection by house members to this bill is the easy way out for the reps, who are in trouble for a million things such as high gas prices, another Vietnam type bogging down in Iraq, high spending on medicare etc. The only way for conservatives to curry favors with their base is to throw in the defense of marriage bill, and do nothing about the CIR. The next few days will be critical for the bill. It dies or goes to the conference where it might come out radically changed.
I am opening a new thread to post all updates on the CIR. It seems today is a crucial day when the house comes in session and work on forming the committee might start. If people hear any updates you can post in this thread.
I read on immigration-law that conservative republications are trying to torpedo the CIR with a new technical legislative argument. It sure is going to be a difficult task to have this bill passed since house has republican majority and they are saying in the media that they will not have the bill passed.
"Report indicates that the House hardliners who opposed the Senate-passed S. 2611 have come up with a weapon to block the House-Senate Conference Committee and the S.2611. The weapon they have hammered out involves a constitutional issue as to whether the provision in S. 2611 that requires guest worker applicants to "pay the back taxes" as condition for the legal status constitutes a federal government's measure to raise the revenue. These hardliners argue that the U.S. Constitution mandates that any legislation to raise revenue for the government must originate in the House and S. 2611 violated the U.S. Constitution by originating such legislative bill in the Senate. When the Congress returns on Monday, there will be a see-saw fight between the S. 2611 proponents and opponents on this legal technicality issue. One wonders how the House hardliners would defend their prior violations in the past in another legislations that involved such legal technicality issues. Besides, there is no clear definition as to whether such back-tax payment requirement indeed constitutes a revenue raising measure. "

So are you saying that date will go back in the middle of the month?
I am saying that GC quota can get exhausted in July. It is possible that it gets exhausted early July since very few GCs would be needed in July.
I don't know if there is a law for retrogressing in the middle of a month. If there is no law, then there may be a USCIS procedure. USCIS has been informing when it sets up or breaks a procedure. It has not done it so far. There may be no legal consequence for breaking this procedure.
If there is nothing written (just good faith between lawyers and USCIS) then USCIS will do anything they feel like. They have been doing it for a long time.
Based on info posted in IV threads, it is not a rumour anymore. Else USCIS clarifiaction would have come out or will come out.
