    Don€™t make a big deal of Shah Rukh€™s detention:One For The Road:Anand Soondas's blog-The Times Of India (http://blogs.timesofindia.indiatimes.com/onefortheroad/entry/don-t-make-a-big)

One For The RoadDon’t make a big deal of Shah Rukh’s detention

After a long time actor Salman Khan has come up with a real gem. On hearing about Shah Rukh Khan being questioned by US security at Newark, New Jersey, he said it’s good that the country has such a tight set-up. And that ``there has been no attack after 9/11 because of this.’’

Salman has a point. SRK might be an icon to Indians and many in the subcontinent, even to the desi diaspora spread across the globe, but to America he’s just a visitor. We may be convinced he cannot be involved in anything that’s remotely violent, but the guard given the responsibility of stopping something like 9/11 from happening in his country again will want to take no chances. And what is the possibility that he’s a die hard fan of the Khan and Bollywood? Very slim.

Interestingly, the same day that SRK was detained in Newark, there came news that the great Bob Dylan, who was wandering around Long Branch, near New York City, sometime back, was asked for an ID by two cops too young to know who he really was. When he couldn’t furnish one, he was taken right back to the resort where he was putting up and staff there vouched for him. And America is Dylan’s own country.

Was there a furore? Not that I know of. Not even a little blowin' in the wind.

SRK says he’s ``upset and angry’’ because it was his Muslim name that caused all this. Thousands of Muslims are made to go through extra security checks everyday in America and a host of Western countries. Is he equally upset at that? He's probably just pissed that it happened to him, India's mega star. We all know how a lot of Muslims have been subjected to prejudice around the world because many countries see terrorism as an Islamic phenomenon. Yes, it is uncalled for, unjust and maybe wrong. But America is a country that takes the killings of its people with the seriousness it deserves, unlike India whose record on this is shameful, to say the least.

Also, because most of the perpetrators of 9/11 were Muslims, America thinks it has to be doubly careful where they are concerned. Had the terrorists been Jews, perhaps it would have looked at Jews with similar suspicion. I was much more aggrieved at President Kalam being frisked. But that’s a dated debate.

There are two layers to the SRK incident and we must peel them off with care. One, it is quite ridiculous that Indians feel their icons and superstars are everybody’s icons and superstars. What the heck? If Jet Li came to India tomorrow, the man on the street here would probably call him ‘`Chinky’’ and not give a second look. For that matter, what if Grard Depardieu came travelling. How many would know him? Matt Damon was here recently and there wasn’t a traffic jam in Delhi. These guys are huge back home.

Moreover, America doesn’t have a culture of fawning the way India has. Mike Tyson was treated like a common rapist and spent most part of his youth in the slammer. Winona Ryder was sentenced to a three-year probation for shoplifting. Chinese born Hollywood actress Bai Ling was fined US 200 dollars for petty theft.

More importantly, we are actually aggrieved because we are ``not like them’’. Well, guess what. It isn’t a virtue. We should be like them and take the security of our country and its people with solemn, no-nonsense professionalism. Frisk Brad Pitt when he lands in India next. Give Tom Cruise the same dose. Don’t spare Bill Clinton either. Isn’t he an ex-prez just like Kalam? Who’s stopping you and what’s stopping you? Colonial hangover? Or is it plain lethargy and callousness. Looks like both.

We are just whimpering over here like hurt puppies because we feel, ``Oh, but we don’t do it to them’’. Oh no, we don’t. And it’s a scandal. We should. I’ve seen white men – and women – get away in India with murder. Indian women can’t get into some discos wearing a sari. And bouncers will frown at you if you are dressed in a kurta. Have you seen what some of these firangs have on them? No one bats a eyelid.
So instead of making SRK’s detention an issue, we should think of upgrading our own security set-up.

There’s a lesson in this. And it is a positive one. A day after our own 26/11, there was hardly any security at CST in Mumbai. It can’t get worse than that. The bottom line: Stop fawning, shed the colonial hangover and make no compromise where the country’s safety is concerned. Can we do that or is it too much to ask from a country that’s been free for 62 years but was ruled by white sahibs for 200?

Members: Please - refrain from fighting about EB3/EB2.

IV is for everybody and IV has always tried to be balanced and fair to all categories. Please read the provisions that IV is asking for.

The goal is for zero backlog -Then where is the question of EB3 lagging behind.

IF we get what we are asking for- ie: recapture, not counting dependants and no country quota, then there wont be backlog in any of the categories.

Why should it be a surprise?
How do PoE officers know if he is a film star in some foreign language movies?
Even if they knew, why is SRK so special that he should not be checked?

There was an instance when a pop singer from India(Daler Mehdi) was accused of smugling illegal immigrants disguised as musicians. Point is, if somebody is a celebrity, that does not make him/her un touchable?

So shall we strip search Barack Obama or Hillary Clinton on their next visit to India? They can also be accused of bringing something illegal, isnt it?

Isnt the visa number limited to a upper threshold for each EB category for each country...How does these number move around between various countries....doesnt that mean people from India and China (2 countries with most retrogression and paranoia) are looking at a very small number (~2K-4K) and not 40K in July?

Can someone comment on this number issue?

Yes I agree.. But if they don't move date foward then they can't approve those backlog applications. And they don't want to loose 40,000 visas . Now when they made all date current, they can approve all those pending application which are complete and just waiting for date to become current. Now we don't know real number and don't know how long it will take USCIS to do all approvals. But if they approve 40,000 in 2 weeks, I won't be surprised if they make it 'U' like other workers.

But then question still remains why they made all current. They could have just moved it by year or so.. And I am sure they know how many application they can expect in July.. I already saw some where that we have around more then 80,000 approved perm.. All they going to apply.. And what about all whose labor just got approved fro Backlog centers?

Its making everybody confused.. But its not in our hand and we can't do anything. Best thing is to file asap and just hope for best and we are always ready for worst..

Just think if they make date 'U' in middle of july, how many member going to loose money. Each of us spent so much money this month and if nothing happens that we loose all of it.

Any of you want to join with me with this drive? Let's form a group and sue the USCIS for misallocation of visa. If any one is interested, please PM me.

immigration-law.com posted country wise EB visa allocation for the year of 2005. For example, Nepal used only 70 EB3 visas. Whereas country limit is 7%. In that case how EB3 Nepal is retrogressed?

Can we sue USCIS? Let's discuss.
In that case, let's hire an attorney.

    Cost = 800 (Medical for 2 persons- Average) + 1000 (attorney fees- doesn't matter who pays- company or you) + 30 (photos) + 100( Postage) + 100(others)

Total = 2000 average . I am not adding application fess since USCIS will send it back if they don't process the application.

Out of 2000 - Medical is only valid for 1 year. In most of cases you will have to pay attorney again. All you can use is photos. I will say everybody atleast lost 1800 ( This is very minimum - also doesn't matter who pays- company or you).

So lets say everybody lost 1800. Now depend how many people were ready to file the application..
Photos are valid for fixed time!
Application Fee : Main Applicant : $375.00 (Application Fee) + $70.00 (Finger Print) + $50.00 (Fedex) + Medical Exam ($250.00) + Photos ($40.00) + Lawer Fee ($1500.00) and if we have any dependent same thing except Application fee and Lawer fess ($325.00 (Application Fee) + 500$ Lawer Fee)

All Togther : $2285.00 and calling here and there almost $2500.00 Per Person .... any other information please ask us........ thanks
My attorney mentioned $745 application fee. I don't have the break up. May be it included EAD and AP fee also!

So I have the following break up

    Primary Applicant

    Application Fee

I-765 (Application for Employment Authorization) $180
I-485 (Application for Adjustment of Status to register as Permanent Resident)
($225 for applicaiton below 14 and over 80 (Should check on this)) $ 325
I-131 (Application for Advance Parole / Travel Document) $170 -
Biometric Recording Fees (Finger Printing, etc) $70

Here is the contact info of this author.

    http://www.flight-capital.com/contact.html

His email is dh@flight-capital.com. The phone numbers are for his sales office of his book. I came to know about this guy from cable news show, I guess it was MSNBC, cant be sure.

I have already written a letter to this guy asking for help/suggestions. I will send a copy of that email to you too.

This man is legit. I found something more on this guy:

    This is from : http://www.redherring.com/Article.aspx?a=14488&sector=QAndA&subsector=PolicyMakersAndPundits#

In Flight Capital, Mr. Heenan says that 1,000 people a day leave the U.S. to return to their home countries. While few countries monitor the quantity and quality of talent that has exited and returned, he says these are the talented people who help drive the pace of innovation in tech centers like Californias Silicon Valley. In the global war for top talent, our competitors arent taking prisoners, he writes. In his travels and research, Mr. Heenan interviewed repatriates in eight countries, including Ireland, Iceland, India, Singapore, China, Taiwan, Israel, and Mexico. Eight of the 11 Americans who shared Nobel prizes in physics and chemistry in the past three years were born elsewhere, and nearly 40 percent of Massachusetts Institute of Technology graduate students are from abroad, notes Mr. Heenan, who has taught at the University of Pennsylvanias Wharton School and Columbia University.

Can they use same LC for more than one I-140?
Trying to understand damage done by LC substitution scams.
My understanding is they can and they do that. U will only know when the AOS is taken up for processing. In this case there were 5 of them on the same labor. Even 140 gets approved, but not 485. I really wud like to know how VISA numbers get handled in these cases.
I know several guys who took this path. Of them only one was a genuine case. All others were some kind of deals. Only one of them had a bad deal(Thanks to Mandalapa). Others r still happy with their EAD's.
I mean this is a widespread practice. I situations like now when we have so few VISA numbers it is unfortunate one for us if those VISA numbers r lost.

Agreed this is discrimination, what stops us from fighting this discrimination using legal class action lawsuit? Is it the money required or did a lawsuit fail earlier that inhibits us to file class action lawsuit?

I agree with some senior members when they say that no one individual will come forward for the lawsuit . And I ask why should they ??

And I think, even if one single or 2-3 people do come forward it will not be possible.

This is the reason we have forums like our IV so that all can come together and take a decisive step together
    .

Who can stop IV to file a lawsuit USCIS ? NO ONE

Many members went on blabbering about how long the process is and how expensive it is ... REMINDER if we can come together and collect upwards of 35k FOR "Lobbying Efforts" we can definitely collect funds for a lawsuit.

Some one here rightly said ...If we are retrogessed and there is a queue ..Is it because of you or me ?? NO it is due to the inefficiency of the USCIS.

NO ROAD IS EASY IN THIS BATTLE..... AND ALL OPTIONS SHOULD BE EXPLORED

Again , I want to reiterate , I think if IV core takes lead...hires a good attorney ....we will have funds for it....we have proved it in the past that IVians can contribute

    Plainspeak.

You have the right to an opinion, after all this is a free country. You have expressed it and some people may not like it. Just care less for them.
But most importantly you need to understand that IV has the immigrant community best interests in mind. After all these are regular folks just like you and me who are doing this voluntarily....and we are reaping the benefits of it.

But again you may have a different idea or opinion which is always welcome for debate. For example i do not support piecemeal legislation(DREAM act) but after hearing IV point of view thats the best shot we have right now. So it made sense to me.

Long story short....IV has our best interests in mind.

Why is it absurd to change the country quota? What is the use of the country quota..is it necessary for diversity? The primary basis by which a person qualifies for employment based GC is through his academic qualifications and work experience....how is deciding how many GCs you would give based on country of birth relevant in this case. What is the basis of such a rule unless you want to limit the no. of people coming from countries which produce large no. of qualified, educated people. How is this fair considering that India and China produce at least 10 times more college graduates than most other countries in the world other than the USA.

If promoting diversity was the cause, there's already a diversity GC process and people from India, China and some other countries are not eligible to apply in those categories.
If limiting people from certain ethinic backgrounds based on current population of USA is a criterion - lets get this fact straight - Indian americans are less than 0.4% of US population there are far more people of vietnamese, philipino and few other southeast asian origin in the USA. In fact if limiting people of certain ethnic background from becoming larger part of the population and maintaining racial diversity had been a criterion, people of Irish, Polish, British, German (or most EU countries) shouldn't be allowed to immigrate to US at all since people of those heritage already form large % of the population. Yet, any similarly qualified person from these countries can get a EB GC in a year or two now while an Indian has to wait 8 - 10 years.

I am quite sure a skilled civil rights lawyer can prove the current situation against Indians in EB category as case of discrimation based on country of birth, since the stated goal of the EB category is immigration based on skills and academic qualifications.

I am the one , who proposed this idea, and people tend to disagree.
I am again saying , the only solution is a lawsuit.

Hello Friends and my fellow GC awaiters..
I have my labor pending for the past 3 yrs (my PD is Aug 2003) and have been waiting for ever. Inspite having a Master's I did filee in EB3 just because I work for a large company which does not allow to file in EB2.

Anyways, I came across a company who said that they have a pre approved labor (late 2002) priority date. Is it wise to go for it or wait for something in EB category to move ahead?. I have at least 1 yr 3 months on H1 and will not have any other options except to stay in the company after 3 months.
Is it worth taking the risk and go with the labor substitution?
The second question/advice I'd like from you is:
If I go back to the same company after 6 months because of some issue with the labor can I still preserve my 2003 PD?
Pls let me know your opinion.
    Thx a lot guys.

Hope is a good thing, maybe the best of things. And no good thing ever dies
    1MoreDesi !
