All the best everyone and may all your PDs become current right away.
I am going back to the homeland.

Can't believe I put my life on hold for this long.
I feel free again to do as I choose.
Just imagining never having to track a visa date ever again makes me feel at peace.
A slave no more for a country that so willingly gives up so much in the name of false security.

Getting used to driving on the other side should be fun!

    Take care!

My I-140 is approved in 2006 and now i have filed my I-485. My employer has not given me any kind of doucments like I-140 approved document or Labour Substitution document. The only form he gave is ETA 9035E after my substitue labour was approved. If I want to change job after 180 days using AC21 do I need any of doucments from this employer. If my employer is not ready to give , what is other alternative. Plesae advice.

Have they mentioned it on their website? Usually DMVs like CT etc.. mention on website that they need a Employment verification letter, as a matter of fact, they don't even accept paystubs they just want employment verification letter.

Folks - my advice is : Please do not argue with the department. Ask them to post their new requirement on their website so that you don't go there and get disappointed.

one doenst have to argue but can definitely question why its not there on their website if its not htere..they just cant decide one fine morning to just start as king for stuff...

    Feb 15, 2006

Today, four members of IV met with 3 staffers from Dianne Feinstein’s office in San Francisco.
Two constituent services representatives, who deal with immigration problems on a daily basis (helping people with labor cert, I-140, I-485, security check etc problems) and one assistant field representative who interfaces with the Senator’s staff in DC on a whole host of issues.

We spent 1.5 hours with them. We went through our presentation, answering questions and giving examples all the way. Then we spent some time talking about how they could help us, suggestions about what IV should do, and how we could work with them. All in all it was an excellent meeting – they were riveted through out – asked lots of questions and were very supportive.

1.Getting the Word Out to Lawmakers

    • They all said they learned a lot from our presentation – the people who deal with immigration problems on a nitty gritty daily level didn’t know the big picture on legal immigration, and the field representative didn’t know anything about the particular problems of legal EB immigrants.
    • The field representative said she had had three meeting with immigration related groups that day already, and that the Senator’s staff has been hearing about immigration a lot BUT this was the first time she was hearing about legal skilled immigrants!!
    • They thought our goals were reasonable and that they would be supportive. They thought we should reach out to as many other lawmakers as possible

BOTTOM LINE: Do you want favorable legislation not to pass simply because people didn’t know about our problems??? No! We need to get the word out.

    • They repeatedly said they were impressed with our presentation (go check it out).
    • They liked the fact that we had an easy to read table which showed which of the current bills addressed some of our goals.
    • They liked the fact that we printed and bound two copies of the presentation to give them.
    • We also gave them copies of our tri-fold brochure
    • We also gave them a number tabbed, bound copy of the following

-Must Read Documents on Legal Skilled Immigration

    a) CIS Ombudsman's Report:

    b) GAO Report on Backlogs at USCIS

    c) Exec Summary of NAS Rising Above a Gathering Storm

    d) How Visa Date Cutoffs Are Established from July 2000 Bulletin

    e) President’s Economic Report: Chapter 2: Skills for the U.S. Workforce.

    3.Action Items
    • We decided to keep in touch – I will follow up on the feedback they get from the Senator’s DC staffers.
    • They wanted to know more about how our meetings with other lawmakers are going.
    • I offered to act as source of facts and examples for their office on these issues – since I have read the relevant documents and data carefully.
    • They suggested that we keep reaching out to members of the House – especially those who are in states without a lot of tech sector firms – those are the people who are least likely to know about our existence, let alone our problems.

BOTTOM LINE: I will keep in touch with all three, sharing talking points and getting feedback.

    4. Lessons for future meetings with lawmakers/ Lessons for other states
    • Do not be intimidated by the idea of initiating a meeting with the staffers of lawmaker – they do this all the time, and are friendly, easy to talk to, it is their job to listen to you– just put yourselves in the mindset of someone telling a story to a friendly audience.
    • Get organized, print and bind copies of the presentation and additional docs listed above to give to them.
    • Do a dry run of the talk, so that you build a narrative patter to go with the slides – this worked really well in this meeting.
    • Whenever possible use examples from the experience of the IV members present to illustrate the point in the slide – for example when we were doing the I-485 Life with and Without Slide, we used Ollie and Neha’s experiences with layoffs and partner not being able to work
    • Ask how you can follow up with them, what they would like you to do
    • Write to thank them for their time and reiterate your basic points

So people from other states – come on lets go!

Are you working for same company since 2001 or you invoke AC21, Can you please share us the detail of RFE (if you can).

I don't know if my NC is cleared. Tried to find it couple of times calling over phone but always ran into unfriendly IO officers.

Got out of BEC in dec 2006, I140 cleared in Jan 2007 but then my PD became current only in June 2007. And due to laziness of my law firm, my I-485 filing did not happen in June and got dragged into July 07 mess.

I think if USCIS had initiated my Namecheck as per normal timeline (sometime around when my I-485 filed , i.e anywhere between July - Sep 2007), then yes, I think it crossed 180 days long time back.

I really appreciate your help Pallavi

I could not think that some many of IV'ans are responding and trying to help each other.

    This is highly appreciable!

They are saying that all those people who were illegal before 1st of Jan 2007 are eligible for Z visa. We all are currently in legal status.
u can easily get an affadavit from someone with a business that says u worked there for a period of x days while ur h1 was with yyy company... that puts u into an illegal category too.

i m growing some tomatoes this summer....maybe i can get additional points if i grow them for 100 days every year and then after another 5 yrs i can get some more points in the new merit based system

I think I have joined IV in last 3 years or so...
Donated money once & have called congressmen & senators many times ...

Could someone please tell me -

What has been achieved by IV till date? I know we all meet elected reps, officials in washington dc ..... but I am interested in end result like not wasting visa numbers , implementing spillover & along these lines.

I have asked few friends to join IV but then if they ask me for IV accomplishments - i can't count any....

If IV has accomplished its objectives, then there is no need for any of us to join. But anyway, the following might be listed...hope this helps.

    Immigration Voice Achievements

    1. September 2009. Streamlining of Security Screening Process for Foreign Scientists: DHS reduced the wait times for Visa stamping in foreign consulates to 2 weeks. A successful campaign was run by IV members.
    2. September, 2009. Successful completion of FOIA campaign: After filing hundreds of FOIA requests USCIS released the data of pending applications on their website.
    3. 2008: Admin Fix campaign. 2 Year EAD announced by USCIS for all that have filed AOS.
    4. 2008. Successful introduction of 3 bills in the House by Rep Zoe. Lofgren. This included elimination of per country limits Bill on which no other organization or business interest had ever advocated until that time. Immigration Voice successfully advocated these bills, brought in co-sponsors and received support from other interests for these bills.

Title: To recapture employment-based immigrant visas lost to bureaucratic delays and to prevent losses of family- and employment-based immigrant visas in the future.
Sponsor: Rep Lofgren, Zoe [CA-16] (introduced 4/23/2008) Cosponsors (31)

Title: To amend the Immigration and Nationality Act to authorize certain aliens who have earned a master's or higher degree from a United States institution of higher education in a field of science, technology, engineering, or mathematics to be admitted for permanent residence.

I think that the DOS (Dept of State) releases VISA Numbers on a quarterly basis. If that is the case, there should be movement in EB2 India in Jan 2007.

You mean Feb of 07, right?

If you can get employer verification letter stating that the position is still available for you and your salary, then file I485 yourself.

I guess most of the folks here are busy preparing to apply for 485. I have different problem here.

My employer's attorney is charging me outrageous fees of around $5000 to
apply for 485, AP and EAD for me and my spouse. This excludes USCIS fees. I work on hourly basis, so I should be taking care of immigration fees. My employer is not allowing me to file through another law firm.

Do I have any other options. How much do they charge usually.

Did you get an RFE before denial?
Could you please post who did the education evaluation for you? Was it a course by course eval?

It will also help if you could provide details on your labor certification category such as
section (203) (3) (i) or (ii) etc.. for skilled worker or professional. I believe You could also find this on your I-140 receipt notice..

'Will accept academic studies evaluated as equivalent of US Bachelors' This wording is tough to handle given that what you have is a Combination of courses evaluated as equivalent to US Bachelors, based on details provided in your post quote "I have a 3 year diploma & 1 year towards Bachelors in business" end quote.

It looks like USCIS has deployed the same random selection program, used for new H1B selection, to process I-485 applications.:(
