Hi,
Is it possible to apply for both PIO and Indian visa simultaneously. My problem is that my son born in US has to go to India in 60days. If I apply for PIO and if it will not come in 4 weeks is it possible to apply for Indian visa and then go to India on Indian visa ?

I agree. I personally wud never do that. i.e Why the hell should we clean the streets of an alien bcos thier system is broken? Thats my personal opion. Didnt mean tio hurt anybody.
Like somebody pointed out, the move shud come from employers. Again taking leave etc for a day(bandh) is the not the way. The govt shud be genuinely convinced of the cost/benefits of ramping up or increasing visa numbers inorder to make any move. We should do stuff in that direction as opposed to expressing frustration.
I am sure most of us here (especially from India) were pampered and did not even clean their own study desks or rooms of their house when they were young, now they are ready to sweep the roads of a foreign country to get the foreign government attention to get their gc :)

Guys, i'm not a member of the IC board or anything, but it's clear to me the benefits of contributing.
Illegals are contributing money, and more importantly their time and particpating in rallies en masse, meeting lawmakers, talking with the press, etc....folks, i'm not saying everyone can do such things here....but the leasst you could do is contribute $100 or $200 to this effort. Writing a check is the simplest thing to do....no one is asking you to stand in the cold air rallying for the cause (altho that would be helpful too...but i know many folks on the west coast, texas, etc probably won't be able to make it).
To put this more directly, if no relief comes out of this immigration reform session for us legal, skilled immigrants, you will have no one else but yourself to blame:(

The case is not in his wife's hand anymore. As soon as the police came on site the case is People Vs Terriblething. Only thing is that the DA may be a little weary of pushing too much if his only eye witness (the Wife) does not want to push the matter.

Looks like the guy we engage for our cause gets a shot to speak about immigration on WSJ and guess what he forgets us all together. Great job for picking QGA core team.

I don�t mean to insult your intelligence, but who ever came up with ideas to ask, celebrities, a noble laurite and other accomplished folks from the immigration community to send faxes does not have the slightest plan on how to make this succeed.
If this is the kind of ideas the �lobbyists� QGA is giving us, may we need some fresh blood in helping us out. I completely agree �eb3retro� in working with AILA.org in helping us get our message across. PLEASE STOP THIS INSANE IDEA OF SENDING FAXES all the time either from members of IV or asking other people to do it on our behalf. We are hurting ourselves and don�t even know it. Can you quote how this is addressing number 1 ?

I got my DL in Colorado just after Sept 11.....and it was for 10 years...luckily. Yes, you are correct Colorado has been traditionally super conservative, but with people from different states moving in..that is changing, only a shade though.

There are Four group of people (Became current with July bulletin) who are affected and suffered.
1) The people whose applications reached to USCIS before 10:00 AM
07/02/07, i.e. before USCIS's new revision/update.
Note: Legally this group is the SAFEST one as their file reached to the
USCIS table on time while USCIS's first bulletin was in effect. Their
case is strong as far as "Law and Justice" is concerned.
2) The people whose applications reached on 07/02/07 but after USCIS's
declaration of new revision.
Note: This group can be fit in a category "Who did not receive ample
notice from USCIS for its intention to change the bulletin. And so
may be considered "Probable beneficiaries" by the judiciary
3) The people whose applications reached or will reach to USCIS from any
time between 12:00 AM 07/03/07 to 11:59 PM 07/31/07.
Note: This group will have a "Strongest" weak argument and case. Their
act of sending files perhaps may not be considered "Law-abiding" as
they have already received ample notice from USCIS and clear
statement of USCIS about "Rejecting applications upon receiving"
then also this group sent the applications.
4) The People who will not send applications at all with respect to the
USCIS's revision.
Note: In my oinion and mostly I believe in Judiciary's opinion thsi group will
be considered "Law-abiding" and who acted as per USCIS's
instruction within the periphery of respecting legal authority.
Now other points to be noted are as under:

DOS and USCIS screwed up? Yes... Did not happen ever and now it happened , yes.. People suffered stress..expenses.. yes. Now what is stressed on is one time bulletin per month is a tradition and it is a long time tradition but probably DOS has a power to change that... It seems that there is no such law that DOS can not do that so there exactly Lawsuite filer may have a weak case. Now USCIS is supposed to follow DOS and make bulletin as per DOS's guideline and that is what USCIS did so where is the "Law-Breaking" ? USCIS acted perfectly in legal manner. Probably if Lawsuite filer decide to file the lawsuite on the basis of "Why the helll USCIS declared "All Current" at the first place" then there they have a chance to make a case strong but if they go another route like "Why USCIS revised the bulletin" then I personally do not see "much worth".
Now having said this, to me it looks like whether you file till in July or not OR whether you become plantiff or not, it should not matter. AILF and/or any other organization ethically and perhaps legally can not define "Class" narrowly to the limited group of people. If real justice is prevalent in this country judiciary should not allow any entity to define "Class" narrowly. To me "ALL affected" is the "Class" and if judiciary is considering it as a "class action" then it should consider "All affected" as a class. Now US justice system would go this way, I do not know but if it is not going that way then I would consider that as abig black loop hole in justice system itself. My guess is that if AILF would go defining "Class" narrowly, there will be some mechanism by which individually or with group you should be able to challenge that legally as well.
Now Judiciary, in my opinion may not take stand that ok this is a "Class lawsuite" and now Mr.X has become the plantiff so he would only be the beneficary if lawsuite is won. Either ALL affected should be considered for whatever the benefits come out or everybody looses it. Same argument goes for people who are not filing. By not filing they are obeying the legal instruction of government department of USA and for that they should not be punished and can not be punished by not granting any benefit to them whereas granting the benefits to the people who clearly challenged USCIS's revision by filing from 07/03 and onwards....
If USCIS is smart, it should accept all files now and create the process to have them rotted in the queue for years and that way it will be able to save its own face and limit on visa numbers will automatically send whole bunch of files for eating the dust for years.
I personally see our strong point only at have reimbursement of the money and time if "We are not getting current before one year (Validity of Medicals)

I am talking about a person (like 485mbe - the one who has posted next to yr post) who has a PD of 2001 ..I am not saying that they should give Eb2's quota to EB3 ..but they should try to pull the category that is worst affected..or atleast give EB3 something ..
my question to you is ..say in the year 2010, would u support a situation where all categories are current or at 1 year difference ...while a particular category (eb3 I in this case) is at 2001 ??.. even if you do ..my feeling is that USCIS will try to pull EB3 - I (if something like above happens)..but then they are just a govt agency ..and in the end they are similar to govt agency in India ..only difference is that maybe little better

But in the poll, 56% of Republicans earning more than $75,000 annually would "strongly" or "partially" agree with candidate who would bar illegal immigrants from path to citizenship.
Look at this. Even when the conversation if totally on "high-killed workers", there is always and has to be always, a line or a sentence about illegal immigrants. Somehow, you cannot discuss anything about anything unless you have one line about illegal immigrants. The only sensible reason to discuss illegal immigration in same topic as "attract and retain" the "high-skilled workers" is that if there are people who are high-skilled, need to be "attracted and retained" and also happen to be "illegal".
So folks, look around yourself, do you find anyone who is "high skilled", "illegal" and also need better laws to be "attraced and retained". NASA folks and folks from silicon valley, please check the cubicle next to you to find an illegal rocket scientist or an undocumented microchip designer. The requirements for the position shouldn't exceed SVP time levels for the job zone to which the position code belongs - that's all I know. If the position code falls under zone IV or V you can require MS.
I still don't understand how BS+5 qualifies for EB2. If the position code falls is in zone V, BS+5 (7 years of SVP) would be a "normal" requirement, but isn't EB2 only for people with advanced degrees AND positions that require the advanced degree?

If you do not get an Infopass appt. walk in ...as it is an emergency (you amy loose your job) ! Take all docs that provide proof of that.
I had seen walkins accepted at my USCIS local office...
I'm went to the infopass website to make an appointment for interim EAD; I chose the "Washington Field Office" since I live in the DC Metro area. There are no appointments available in Aug and Sep!
This is unbelievable! What other options do I have?

Guys, as we all know we can not build our careers on EAD and TD. For a permanent solution, join us in the DC rally!
This is what happens after 485 receipts.
1. If one has not applied for EAD and TD , one applies for them and wait anxiously for their receipts.
2. Meanwhile some people start getting FP notices and one does not receive them he or she gets anxious. Finally one gets FP.
3. Meanwhile one gets the receipts for EAD, TD. One keeps checking the status online.
4. One goes and gives finger prints for INS.
5. Finally one gets his or her EAD and TD after 5 to 6 months , One enjoys the moment briefly.
6. Its almost a month since one received EAD and AP , Its time to apply for renewal.
7. Repeat step 1
8. Its almost 15 months since the first FP and one receives the second one because "Finger prints expire" ,
One has to repeat these steps in a cycle for almost 6 to 10 years depending on PD and "Nationality"
Meanwhile if USCIS changes any processes anywhere in the pipeline expect further delays.
I think best thing is to do participate in IV activities.

I have been thinking for a long time to own a gun but due to my H-1B status could'nt own one. My I-140 was approved last year and now I am working on EAD.
I am wondering if anybody else in a similar situation purchased a gun; I mean after he/she started working using EAD. I tried to research the issue but the law is not clear on the subject.
