For couple of weeks in 2001, when I was getting H1 transfer, I was without pay. I applied H1 transfer before old H1 expired, but got the receipt notice after few weeks and only after that I started working. Am I out of status ?
For that matter, is it out of status if one gets paid from 2 companies with
2 H1bs ? If one is on bench but getting paid by one company, starts working with 2nd company on new H1b?

My situation,
I am a july 2 filer, planning to use EAD to work in diifferent company in same profession(NOT invoking AC21). On I-485 approval want to come back to the original employer who filed I-485. my company is supporting and willing to support for any RFEs.
Please tell me if it is going to work and what are the risks involved.

I am talking about companies like Infy, Wipro etc..
Infy, wipro, TCS and all the other hundreds of so called "Hi Tech" companies are just glorified body shoppers.
The media has hyped these "coolie transporting outfits" to be path breaking businesses.
Adding insult to injury, INFY is soon to be listed on the NASDAQ 100.

Based on my receipt numbers and looking up on USCIS website, it appears my AOS application that was sent to NSC has been sent to California Center. I have not seen anybody's case being sent to CSC. Dunno how good or bad it is and whether it sppeds up/delays my EAD processing. Anybody had experience with CSC and got any of EAD/AP/GC approved from CSC.
My daughter's AOS: filed at NSC tranferred to CSC (RN say so) again transferred to TSC (online status: transferred to area Jurisdiction) so are the delays

don't you think they will face problems in 140 if their education doesn't match that in labour... its not as easy as you told..

You are right, they will face problems in 140 and they do.But you know what, thats why we have lawyers & education eval agencies , if you pay them they can make any degree or exp look like , anything else.
I know a guy who had BSC & got a sub labour , he had got many RFEs in his 140 , I don't know what happend in the end , but what I feel is, some of them can still trick the system.

'EAD Inquiry Appmt' even when you are going with AP question.

This Jan 1,2007 date is another Joke by this lawmakers. These undocumented workers came crossing the border without any port of entry evidence. How can they prove they came before or after that date.

Employer letter is not required if you are attaching photocopies of two current pay stubs.

You would need employee letter as well. The employee letter will state that the position is still open and they are willing the pay the amount that was initially agreed to while filing for labor.....so pay stub is not enough.....

Sorry, I did not raise my arm to indicate that it was ALL sarcasm. Durbin is aginst H1B. Although his press release says that he is not against green cards, but thats just bull.
And if he is appointed Labor Secretary, that will be the last straw to break the camel's back.

You are not the only one. I have been waiting for my GC for 8 years now and it is nowhere in sight! I took the plan B (Canada) and became a PR there (it tookj just over a week, without the need for a job and without me leaving the USA, except to "land" there as the final step). Canada is not as bad as people may think. It looks just like the US, in many cases people are way nicer, multiculturalism is encouraged and enshrined in the Canadian constitution (as opposed to assimilation in the U.S.) and you have free healthcare and free social security for life, whether you are employed or not. Finally Canada has consistently ranked as one of the very top places to live worldwide (ranges from 1-5, it is 3rd this year, with U.S. in like #8) and there is so much to do there. Anyway, for a plan B, Canada is quite honestly pretty damn nice.

The DREAM act is specific in that it only applies if you can prove you came here and still remain in ILLegal status. I have a son who aged out a year and a half ago. I CANNOT support an act that gives an illegal child of the same age a path to green card that does not provide at least the same for him. If we can get the act amended to include all children who do not have a path to residency and ultimately citizenship that would be OK.

If you dont have a lawn / garden, then go to walmart buy something and sell it for a dollar more to your fellow H1b. Let him do the same for you and you both declare that you did some side business and made a dollar. YOU BOTH ARE ILLEGAL. HEyyyyyy you qualify for Z

I got my I-140 Approved in 2007 and I-485 applied in July Fiasco. working for same employer who filed labor in PERM. Recently got letter from DHS stating that I485 denied as it was filed when dates are not current.
In july 2007, USCISreleased memo stating that they will accept all applications till August 17' 2007. Mine was reached on Aug 14'2007 well before deadline. Got I485 reciept in october 2007.
There are 2 dates on receipt. 1. Received Date (Aug 14) 2. Receipt Date (Oct 12 ' 2007).
They sent Denial letter to Attorney on 01/19/2009 stating that I485 application was filed when dates are not current , they mentioned that on the day receipt date (oct 12' 07) dates are not current.
Took Infopass and went to filed office where I was told that if I this it is USCIS Service error, file MTR .
Filed MTR thru Attorney on Feb 5 09. Filing Fee is not enclosed as it is USCIS service error.
(This was done as officer at USCIS told that Fee need not be included as it is service error, attorney also agreed with this statement).
Till date I did not get any communcication from USCIS. 2 months have been passed.
Please advice me on this issue

USCIS mailroom has certain protocols and thats why even our AC21 documentation does not reach file.
Files are distributed to different officers and they work on the files.
Without a receipt number you cannot track your MTR.
Talk to a very good Attorney on further course of action.
I filed MTR - my 485 was denied because the officer ignored the AC21 job change. When I called customer service and explained - I was transferred to a VO and when I explained it, she requested me to file an appeal so that I don't have to pay instead f MTR.
When I talked to Attorney - she said "Don't do that - when your MTR gets receipted, you can track it but cannot track an appeal"
Remember MTR = if USCIS makes a mistake - MTR costs $$
Appeal = if you want AAO to consider various factors on a correctly interpreted denial and appeal to see if you can convince.

Even though your I-140 is not approved at the time you invoked AC21, USCIS while adjudicating the petition should determine whether the I-140 was approvable at the time of filling? Please read the memo, if you have not done so.
In nutshell, I-140 approval is not required for invoking AC21, if application was filed concurrently and has been pending for 180 days or more. Attorneys ask you to remain in your job, so as to minimize the risk.
Kindly see the context of the post and please read the post completely before going ballistic �

If you have any doubt, speak to an attorney. But you are welcome to do whatever you find is best for you. I have changed employer using AC-21 and simply attempting to provide the information about practical implication/ramifications of AC-21 from my experience and knowing. As always, you are welcome to do whatever you deem fit in your case.

For the past five years, i have been dealing with the SFO Indian consulate and they have been extremly efficient in processing my papers, when i have sent them over , be it for Visa or Passport.
Yes their customer service is not up to the standards but they have always responded positively within two weeks
