I totally understand that reporters may skew facts to their specific needs and know first hand that the EB-3 category is retrogressed across all nationalities. I am one of your members that is not from either background mentioned.
I was responding to a post on this forum (and not the press in general) that implied that this issue affects people from specific ethnic backgrounds, which is false.
I do have a general issue that people seem to forget that.
I applaud all core member efforts, however negative this post seems.

Agree on ur second point, however I was surprised with the context that "ok lets see how much we can buy the MS course and how soon can i finish it" as supposed to it will be great to do MS and lets see how I can further my career with an added benefit of getting C in case of GC process.

Going back might be a good call. But the truth is, no matter how much money you got, how secured you are, the bottom-line is that the call has to come from the individual.
I will share my concern. I was 23 when I moved here and I already spent 10 years of prime life here in this country. After finishing my college, I worked in India for a year and half, and as any young adult I grew up thinking one day, I will change the way life operates in India. There is a system which operates India. It is powerful, normal human like you and I cannot overcome the system. People like Gandhi could, they are willing to sacrifice them self for the best of others. Or you could people like our current politicians who know how to work the system. People like lallu, Jaya, Karunanidhi, Naidu etc, they grew up as a part of the system. For them even when killing someone, they might not feel the remorse. But you and I cannot even bribe without feeling bad, which is good. But the question is how long can you sustain that? I am not 23 anymore; Now, I know what responsibility is all about. I have 2 kids; I don�t know whether I am hard enough to fight the system at this current stage of my life.
There is a famous quote, which states that there is a breaking point for every human, once we are pushed beyond that point, your action does not originate from your brain. In other words you will become part of the system.
For me this is the main concern. When I talk to people here who wants to go back, they say that they will buy a house in some close community and they will live a happy life inside. For me that�s a fools dream. You cannot shut off from others, may be for a month or two, soon you have to face the real world.
So the answer for your question like in this question. How are you going to handle the system in India? I do not believe that things will change. May be in 25 years; Not anytime soon. So until then you have to live a life where in you have to adjust to the system.
I do not have an answer to the question. How will I manage the day to day life? If you know the answer let me know

Welcome back UN. One question. Does the USCIS have ability to check credit histroy.
There is nothing in the law; where USCIS can deny a person's 485 due to bad credit. Therefore, they wouldnt' have any interest in checking this.
They are on record that they will check publicly available information in help adjudicating cases. They usually; do this on h-1b petitions. They'll check the company web-site; company registration; whether office is in a house, virtual office, web-site of company giving purchase order, etc. They frequently quote whatever they find in denying cases.
I actually came across a case where a company had 14- denied for ability to pay.
There was a merger between companies and the new company filed the 140 using old companies labor.
In denial; USCIS said they didn't believe the merger because a search of the california business portal showed that the old company renewed their business registratoin (evidence that it wsas still in business);
since, president of the company had same name last name as person being sponsored; USCIS actually retrieved the president of the companies greencard applicatoin from 10 years earlier and quoted that the candidate and president were brothers because according to their g-325a's they had the same parents. They denied the ccase and invalidated the labor due to this.
I remember back in 1994; IRS said that they were going to check peoples credit applications and comparing to peoples tax returns; they were going to try to compare the income people listed on their tax returns to what they were putting on their credit applications.

However, they have a lot of other ways to verify this that they wouldn't need to go to a persons credit file. I know with the economy the way it is; people seem to be worried that declaring bankruptcy or having negative credit history affects their 485. However, not paying debts isn't considered criminal that it would impact a persons applications.

I recommend every one writing their own words rather than doing the copy/paste. If I were to recieve 10 emails with exactly the same content, it might make me feel like some ONE just sent 10 diff emails. IMHO, Its a good idea to write the gist of the story in your own words. Save it and use it for all the people in the media.

Also there are lots of Eb3_india gyus are waiting with PD being current. PD being current is not important. Getting GC is important.

Dear Editor
You mention in an article dated today that "HIGH-TECH EMPLOYERS get lift from House Republican letter to Speaker Pelosi urging passage of immigration bill to help "attract and retain" high-skilled workers". And in the same breath you say that "In a poll 56% of Republicans earning more than $75,000 annually would "strongly" or "partially" agree with candidate who would bar illegal immigrants from path to citizenship." Do you know the difference between highly skilled legal immigrants and illegal immigrants?. Why do you have to imply that all highly skilled are illegal, infact 99.99% of highly skilled workers (Tech workers) came to the USA legally and continue to live legally. To put out a fire and to prevent it from happening again you need two things:
(1) Take the fuel away
(2) Take the Oxygen away
(3) Make sure you don't have any sparks flying around.
Immigration reform, whether for legals or illegals, needs massive support from the American people. Most of the people are in no mood to support a "reform" unless the president can stem the flow at the border.
To able to get any kind of immigration relief legislaton through, the president needs to work hard and quick at sealing the border shut. Time and again "the other side" has laid this as a pre-requisite to any immigration related dialogue.
I don't know why this is so hard to do. The border is there for a reason and it is the Federal government's responsibility to maintian its integrity, whatever it takes, National Guard, drones, US Army..whatever.
That being said, don't read too much into this "Thursday speech by the president". It is lip service, or as go_guy pointed out...political posturing.
P.S: Admin, deleting my posts will NOT get you your green card sooner.

Remember, 245i cases were the NOT the same as the mexican illegal aliens that are being spoken of in relation to CIR .. lots of educated, legal H1-Bs lost their jobs (and their legal status) during the dot com burst of 2000 - 2002. Some of them stayed on even after going out of status, and then became eligible to file for GC under 245i.And needless to say, many more of those H1s came from India than mexico.
There are also Non-RIR cases that were applied in apr 2001 still pending in BEC. I personallly know few of my friends whose labor is still pending in BEC with PD apr 22 , 2001.

I am 3 year Eng diploma + 1 year Eng post Diploma + 10 year exp in India + 5year Exp in US before filing Labor Cert .
I do have a copy of the Educational evaluation used by my old attorney which says US master equivalent.
As one member pointed out , there is a possibility that my original employer might have sent a letter saying Labor cert has mistakes but I have no way to confirm that . Or it could that the Officer is just trying to find any small thing to make the case deny.
I am digging all my old docs to give it to my attorney and see what he is going to day .

1. Your spouse can't work . Think about their self esteem and self respect they are loosing.
2. You don't know about your future if tomorrow you loose your job , you will be kicked from this country.
Tell me what is hell then ? Don't think its just about counting dollars , think about your life stability and about your family members too. I agree with you. PenDot does not give online extension for non-immigrants(if it was mentioned originally that you are foreigner when you first got your license). Also they extend visa for H1 only after you get approved extension letter in hand. They do not accept receipt notice. I think they accept i-485 receipt notice to extend you Driving license though.

This is wrong. EAD can be issued when both of the following conditions MUST meet:
I140 has been approved
I485 application is 180 days old
Thats incorrect, You will still get your EAD if I-140 is pending. But, in futiure if your I-140 is say rejected, you will be instantly out of status (If you are on EAD).

AILA prepares the lawsuit and some (probably most) of the lawyers are supporting that.
For several days I keep hearing that WHEN you file (in July) is not important and I am wondering how that could be true...
I understand that the people who filed on July 2nd are beneficiaries of this but in my mind, everybody who files after falls under a different category because technically they would file after the revised bulletin was announced therefore have no argument. I understand that everybody else prepared (legal fees, medical exam and so on) and they are affected even if they didn't file but I am wondering how that can be justification enough after the dates (retrogression) were announced.
I am trying to understand why they say that it does not matter when you file. They need more people to back this up or is just so they can justify billing you for their work...
Is just scary, how many people play with our hopes and I need to understand if this is just to serve somebody's interests or it is what it is .
Please post your 2 cents ...

I have purchased 4 firearms during my nonimmigrant status, including a handgun. Nonimmigrants can generally not own firearms in the US. Though, there is an exception to the law if you possess a valid hunting license and have resided in the US for more than 90 days. I took a hunting class, which was a prerequisite for the hunting license and also had very good firearm safety information.
For long-guns, you will need some paperwork before you go to the gunshop (utility bills from at least last 90 days, hunting license, Driver's license, your I-94 number). The background check will probably be delayed a day or two while FBI checks your immigration status. Your gun seller will call you when they get the ok.
For handguns, there may be additional paperwork. I had to apply for handgun permits with the local sheriff's office. The person you first deal with will probably be unaware of the exception for individuals with hunting licenses. You will probably need to take a copy of the law (ICE has a pamphlet on firearm laws for nonimmigrants, take a copy with you) and talk to a supervisor. Once you get the permit you take the permit and your DL to the gun seller plus all the paperwork I listed for long gun purchase. Let me know if you have additional questions. Good luck.

yup, with a *** for the comment (atleast in my case). Did not even have the decency to explain what part of the post he disagreed with, or discuss it on the forum... hide like a coward and shoot in the back...
