I had a question on the experience at POE if one has used AC-21 and working for an employer who is doing the W-2 but the person actually works at the client site.
All the posts I see here have been that people were randomly questioned on POE about whether they are still working for their sponsoring employer or not?
What about my case? I had filed I-485 during July fiasco, had an approved I-140 then. Changed jobs on EAD using AC-21 in Oct 2008, and again changing now second time.
The first change I did was when I was working with the same employer who had given me
the EVL.
I never travelled out of US during this time.
Now I will be working at a client site, which is different from the employer's address. Just want to know if there could be any issues?
Or is it advisable to not go to India until GC comes... which could be infinite number of years...

As I mentioned in my post, I had a resident Indian A/C - account that was opened when I was legally a resident Indian (salary a/c incidentally). No way it can be confused with one of N/RE/O accounts. I had INR in my account. It was wired over to my account here in the US, I got $s. Simple. If you look through the link that I posted, ICICI's instructions are quite clear - you can say family maintenance as a good reason.
As a couple of people commented in subsequent posts, it is straightforward to send money, INR to $.
I read somewhere that according to RBI rules an NRI is not supposed to maintain any regular account in INDIA. One can only ve NRO/NRE accounts.
You said yu got the money from the old account. Do you think it was all according to RBI regulations

Thanks for the reply. I am not sure how that will divide the community. As per USCIS laws currently, the spillover is horizontal. Based on this assumption, will EB3-I get any visas if the recapture is successful?

My wife's H4 expires on Oct 1, 2007......We plan to file our I-485 by July 16, 2007.......I am sure it will take atleast 90 days to get her EAD.....whats her status between Oct1,2007 till the time EAD gets approved?......Will she be in valid status during that period?

Going back might be a good call. But the truth is, no matter how much money you got, how secured you are, the bottom-line is that the call has to come from the individual.
I will share my concern. I was 23 when I moved here and I already spent 10 years of prime life here in this country. After finishing my college, I worked in India for a year and half, and as any young adult I grew up thinking one day, I will change the way life operates in India. There is a system which operates India. It is powerful, normal human like you and I cannot overcome the system. People like Gandhi could, they are willing to sacrifice them self for the best of others. Or you could people like our current politicians who know how to work the system. People like lallu, Jaya, Karunanidhi, Naidu etc, they grew up as a part of the system. For them even when killing someone, they might not feel the remorse. But you and I cannot even bribe without feeling bad, which is good. But the question is how long can you sustain that? I am not 23 anymore; Now, I know what responsibility is all about. I have 2 kids; I don�t know whether I am hard enough to fight the system at this current stage of my life.
There is a famous quote, which states that there is a breaking point for every human, once we are pushed beyond that point, your action does not originate from your brain. In other words you will become part of the system.
For me this is the main concern. When I talk to people here who wants to go back, they say that they will buy a house in some close community and they will live a happy life inside. For me that�s a fools dream. You cannot shut off from others, may be for a month or two, soon you have to face the real world.
So the answer for your question like in this question. How are you going to handle the system in India? I do not believe that things will change. May be in 25 years; Not anytime soon. So until then you have to live a life where in you have to adjust to the system.
I do not have an answer to the question. How will I manage the day to day life? If you know the answer let me know

I think I know you, sorry I am kidding :), cuz pretty much everyone's story is very similar to yours, I tend to agree with you, but itz not that bad, infact I would itz a good gamble if you return now you will be going to emerging market and you might endup making most of it, About bribe and corruption if you study the history it was created out of bad politics and system as things are changing with better system it will be reversed, you will never have political system with out corruption atleast there none exist on face of the earth, I am positive about India and itz growth,

As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending, with approximately 64 percent (211,341) of those cases pending more than 90 days and approximately 32 percent (106,738) pending more than one year.
While the percentages of long-pending cases compared to last year are similar, the absolute numbers have increased. There are now 93,358 more cases pending the name check than last year. Perhaps most disturbing, there are 31,144 FBI name check cases pending more than 33 months as compared to 21,570 last year � over a 44 percent increase in the number of cases pending more than 33 months. The backlog appears likely to get worse, because a USCIS fee increase -- slated to take effect in July -- has prompted a 50 percent rise in new naturalization applications so far this year. Currently, USCIS has limited capability to produce reports detailing the status of long-pending FBI name check cases. In addition, USCIS systems do not automatically indicate when a delayed name check is complete and the case can be adjudicated. This is my thought process (also referred by Ron G):
July 2007 brought in approximately 500K 485 cases.
We do not know how many cases were pending as of June 2007.
Fiscal year 2007-2008 USCIS used over 140K EB VISA numbers (I think it was around 155K).
Fiscal year 2008-2009 USCIS will use atleast 140K EB VISA numbers
so, 500K - 300K = 200K.
Assuming USICS approval rate is 85%; 75K of 500K are denied.
200K - 75K = 125K EB cases pending from the July 2007 cases.
Additions: from all current categories - may be 25 K in 2 years?
So, 150 K plus whatever that was pending as of June 2007.
So next fiscal year, 2009 if USCIS uses the quota 140 K, most or all of the 2007 filings will be cleared. If not EB3 I, definitely EB2 I and C, EB3 ROW will be cleared.
Depending on new filings, EB3 I might retrogress but retrogression might come within 3-4 years instead of current 8 years.
I strongly believe, beginning Jan 2010, dates for EB2 (I and C) will move forward heaps and bounds followed by EB3 ROW.
As per replies to senator from USCIS
EB2 india has 50k and Eb3 india has 70k apps. See last 10 years with horizontal or vertical fall none get more than 15k in a given year.
If they do get same spill over then Eb2 india needs 3 years and Eb3 india needs 4 years after Eb2 get clear. OR USCIS stop receiving app from any one for next 1 and half year and then start accepting agian. ( Which is not possible as per law ).
So bottom line is
Either Recapture or removing counrty cap will end current backlog , both will end current as well future backlog and none will make situation worse if more demand from ROW.

Same with me too. My application was moved from NSC to TSC and has been lying there since then. Hasn't been assigned to an officer yet:mad:
I never had any RFE, but my case has been bounced around for no reason. From TSC->CSC->TSC and I am told that it is not even pre-adjudicated not even assigned to any officer as yet. I have yet to see any more illogical organization other than USCIS. :mad:

I did call USINPAC too and left a earful on their voice mail.Looks like they are all busy at this time figuring out which is the next item/development around the world that they can take credit for.
My friend who called USINPAC this AM tells me that that fraud Sachdev is right now in India. Wow wow.....
