    It will be intersting to see how Indian Economy will flare, which is essantially driven by Outsourcing, which will take the greatest hit.

    Remember Indian Economy's engine is outsourcing, once it starts to see the $ exchange pressure, forget about people coming to US, think of what will happen to standard of lving in Inida.

    Can India still maintain the new glow with dollar coming down , I doubt as the Govt of India has not made any big steps to make permanent changes to infrastructure set up.

    More Mc Donalds, Pizza Huts, Starbucks, Wal Marts will come up in addition to Coke and Pepsi and also mor eand more American companies will come there and pick up the money.

    So they will neutralize

    Someone has obtained the number of pending 485 cases working with a Senator. Those are the kinds of information that we should try to obtain and then make a educated estimate. When that estimate is alarming , initiate some actions.

    To OP: Why didn't you add your parents to your GC application as your dependents? Check if you can do so now..?

    I believe its only for spouse and unmarried kids under 21.

    No point in showing frustration. Its not our birth right. We all were well educated before we came in here. Situation changes. And system makes an adjustment. Dont blame your country( I am also from India), for no one asked us to move out. There are so many nice positions available to work for. More than 80% of us found here a better oppurtunity, because there were no competition at all in getting jobs. 1st come 1st serve.

    So do not complain. They do not have any urgency to hand us over the GCs. We can only request them to do the needful on the basis of our sorry state of affairs. Again, we are still at their mecrcy.

    So stop complaining. Either wait and support IV or boot out.

    Very well said..I have many desi ppl at my work place who gag about H1b slavery blah-blah..Not giving GC early..

    People need to understand. (Offcourse its frustrating to wait for..but no one forced us to stay here..or come here)

    Its very interesting to read about people�s different perspective about same thing we are all after.. lets ask ourselves.. honestly why we do want GC and I am sure we all would have multiple reasons for this in our subconscious but would not like to bring it to forefront because it would only undermine our own ability to fight it or make life more stressful.. but end of the day we all want this card.. for me I want it mainly for security and peace of mind�lets look at the different situations.. these might be extreme but we all might have thought about these situations atleast at some point in the recent past� .. and especially the people in the seventh year

    1. You are in your seventh year� and you loose you job�.what is the first thought that comes to your mind.. I got to pack and leave .. pack your home of seven years and all your possessions you collected, in two suitcases of 50lbs each and leave�forget the Flat Screen TV,, forget all the electronics and the two cars you love ... just list them in craigslist �

    2. You have home which you bought with so much pride�what do you do? ..List it.. make a desperate sale in this falling market.. loose a ton of money and leave�and don't even talk about all the silk plants..floor lamps.. the furnishing,, they are for the yard sale on the Saturday..

    3. You have child whom you love and have plans for them.. love the school.. are an active member in the PTA � all of sudden what you do.. pull them out of school, move them from the only culture and the country they have known the only President they know is Bush and the only national anthem they have learnt is "The Star-Spangled Banner"�to another place where they don�t even understand the language forget the culture, national anthem etc..

    4. Think about your spouse.. they have adopted themselves to this lifestyle.. probably felt lonely when you moved here 7 years but now like it.. its time for them to move back�why because your don�t have a GC

    5. Forget the Golf and Tennis you enjoy so much here �it was all a very good dream..

    1. You are educated.. have a masters, have a professional degree.. but have been in the same position and department because of your long wait for GC, what happens� the fresh college graduate or the dumb blond who joined two years back and whom you taught how to log into the network is now your peer and you are still on the same desk doing the same job getting the 2% raise and working even more that you can keep you job..with a new dumb boss.. who thinks you are so dumb that you have been in the same job for so long time..
    2. All your batchmates are doing great..some of them are now sweating to be VP�s having risen by changing jobs �. You are still years away from that situation.. what do you do.. stop attending alumni meets and envy the mails in your yahoo groups from people..
    3. Seven years in US.. you have made your professional contacts.. and have a social network.. in which you invested your time and effort.. loose your job in the seventh year.. and all these contacts are nothing but an occasional international long distance call in future..

    Last but not the least� flight back home to your country is not going to be as smooth as the flight to US was seven years back.. back home look for a job..learn the whole new professional culture �and then set up a new home,,new school for kids�.why because we could not get a GC.. which was not in our control.. and because some stupid insane guy sitting in cave 10K miles away decided to terrorize the people in America in 2001.. and make life difficult for all the people..including people in H1...

    We might all go back to our home country one day.. but the ride back home would be much more pleasant and happier of a choice we made and not because we did not get a GC�

    I just did No. 2!!! Yes, sold my home off recently and now living in apt. I am single and no family so I am more flexible when it comes to leaving the US. Also, because I have been in my field of work for 10 years and feeling a little bored with it and wanna go back to uni to try another field, but don't want to do it in the US in case I lose my job and then have expensive bills to pay.
    With that GC, at least I can feel more secure, will have the ability to find a local employer while going to college, etc.

    Yep. Got copies of labor, I-140 forms and approvals via FOIA. :)

    Can you tell me the procedure to apply for FOIA and also how long did it take you to get the copy of labor . Did you use an Lawyer to fet this info ?

    I am trying to get the job description on my labor . My employer is not providing me the same .

    i am looking for help in wrongful i485 denial of 485 with ac21 .

    Below is my situation .

    Company a :
    Pd: 12/31/2003
    category : Eb2 india
    labor cert approved : 3/30/2004
    i 140 rd : 4/13/2006
    i140 approved dt: 9/21/2006
    i 485 sent : 7/2/2007
    i 485 rd : 7/5/2007
    i485 nd : 7/13/2007
    finger print : 9/2/2007

    company b :
    Joined date: 2/14/2008 (after 6 months)
    filed ac21 by company attorney
    contacted congressman's office when pd become current for more than a year but no approval. Got response that it is pending in extended review.

    Left company b to move south side because of health issue ( winter) .
    Company b understood the situation and left in good terms with them.

    Bill rate? 70/30 basis?? Contract??? I would like the OP to report his employer to DoL. DoL and USCIS will kick both the OP and the employer. It is easy to get carried away saying that the employer is blood sucker etc. But very clearly, you should know that there can't be these kinds of contracts on H1. The employer knows that people who go to them are on thin ice, and so does the employee (employer is there to do business -- he is not running charity).

    Maybe you guys want OP to go to DoL so that both the employer and OP get kicked out of this country (that is good for all of us) due to obvious immigration fraud.

    To top it, OP goes on an offensive when people point of the bitter truth to him. This site should not promote illegal behavior, anybody seeking advise on these topics should be severely castigated, because they broke the law too (and they know it, just dont want to admit it). Or maybe we should encourage these people to report to DoL so that all of them can be punished for misusing the laws.

    While I did not suggest him to go to DOL. Let me tell you that working on hourly wages is legal on H1. The best solution is to find the job quietly. How do you know how much is his employer making and what he has got? There could be very significant difference.

    The notice doesn't say that I-485 was denied. for I-140, it says notice of Automatic revocation. For I-485 it says Acknowledgement of withdrawl. It looks to me that my previous desi employer actually withdrawn the I-485 application and thats the reason it says the I-140 is automatically revoked.. But how can they withdraw my I-485 application ?

    The earlier who mentioned about hard hitting a car on Tree/building to shake the robber and run away is absolutely misleading peoples. There is no reward for bravery or mental sharpness in US for folks who wins a fight with robber or outsmarts them.

    How much the Robber can steal from you - Couple of hundred cash, 5 credit cards ( which you can immediately cancel if you are not injured) and some important contacts. Be Nice with him and give him what he wants, tell them that you understand their situation and be sympathetic and polite with them.

    I once did that and the robber just took 20 bucks from my wallet, 3 Marlboro Lights cigarettes and returned me the rest of money,credit cards,my SSN card and important contact papers and my rest cigarette pack and told me "you look like a nice guy".

    Don't panic seeing robber or don't make the robber panic by shouting or banging your car on the building :) Robbers are just human beings like us with pathetic economic conditions ....

    Yes, the most important of all, you don't die for 20$.

    The smart way is: be nice to him, he'll be nice to you.

    here is what i suggest:
    create a yahoo group or blog..and have ppl publish the name anonymously of the desi bloodsuckers...some kind of activism is required..instead of coming on this board like some ballless buggers and crying like babies...grow up and take back ur life...bytch..;-)

    btw..i am not in IT so..i dont have to deal with suck suckers.. i have read so many posts abt this.. i am fed up..

    It would give some idea I think

    In order to determine whether the alien truthfully represented his or her intent to remain with his or her petitioning U.S. employer after receiving the green card, the USCIS uses the standard created by Seihoon v. Levy. That is, USCIS examines the “rapid course of events” following the alien’s receipt of his or her green card. The Department of State has reduced this rule to a 30-60-90 day formula which USCIS generally follows. If an alien ends employment with the petitioning employer within 30 days of receiving his/her green card, then it is highly likely that USCIS will decide that the alien’s intent at the Consulate interview was not, as he/she stated, to remain with the petitioning employer indefinitely. After 60 days have passed, it is less likely (but still risky) that USCIS will determine that the alien lied about his/her intent at the Consulate interview. And after 90 days, it is highly unlikely that USCIS will have a problem with the alien’s change of employment

    Maybe this 30-60-90 rule applies to people with Consular Processing or someone who enters this country on Employment based GC and who leaves the employer right away after coming here.

    For majority of people here in US, they might have already worked for a given employer for 3-6 years before they filed 485 and got their GC and completed their 6 months after AOS application to kick in AC21. So for such a person who has sustained abuse by working at the petitioning employer for 3-6 years, does he need to show any more intent?

    WithoutGCAmigo, no panic. there are processing dates which you should be worried about after you file EAD / AP etc.

    To file it goes per visa bulletin. Hope you are upto date with that.

    Bulls eye. this is what I am thinking.

    I am looking for an answer in general for all.

    As Chandu pointed out, in general, AOS (pending 485) status gives some protection in terms of maintaining legal status in between jobs. 'Technically' once six months are completed at the employer on whose job the I-485 has been submitted - we should be good. But the issue is AC21 process is not a well streamlined one - no forms etc. Earlier the volume of these cases might be very low for USCIS; now after the July 2007 there are lot more people in the I-485 stage and recent economic conditions could have contributed to large number of people using/potentially using AC21 process to change jobs. Heard many issues - hope USCIS will streamline the process for AC21 job change issues.

    EAD Renewal's are eligible for premium processing, so if you really need a renewed EAD to change a job, it's almost comes down to paying an extra $1000 to get it within 15 days. As far as a new EAD goes, USCIS will have to process it within 90 days. Now that they have stopped issuing Interim EAD's , if you go to to the USCIS local office after 90 days of filing the initial EAD applications, they are obligated to come back to you with an answer on why your application has still not been adjudicated. If you do a google search on interim EAD termination, you will find a couple of links about some law firms planning a class action lawsuit to dispute this. This is still not an issue because most people get their EAD's within 90 days, but you can almost bet your bottom dollar that there will be a hue and cry( read class action lawsuit ) if the first time EAD's get delayed more than 90 days because of administrative delays for reasons such as backlog.
