    So what is the general feeling about the Original GC sponsoring Job, Should we continue the Primary Job and Start a company on the sides. In my case

    1. I am not on H1B anymore
    2. I am already using my EAD with my GC sponsoring employer.
    3. My Employer is ok if i leave the company ( i have been with them for 6-7 yrs now and they have made enough from me...fair enough i think)
    4. My employer will not revoke the I-140 for sure.
    5. My client is ok to work with me if i start my own company.

    All the above points make me inclined towards starting a company and work for it, Do you think it is not advisable to change the employer specially in the case when you are starting your own company..

    WASHINGTON, May 11 � Senate leaders said today that they had broken a political stalemate and would bring to the floor next week an immigration bill that could put millions of illegals on the road to eventual American citizenship.



    Its a positive developement indeed but looking at the tone of both, Reid and Frist it seems their primary motivation is to "show" that they are not sitting on the issue but doing "something"...in other words a genuine concern for the plights of immigrant in waiting (both legal and illegal) doesn't seem to be the driving force but rather both parties are looking for bragging rights on the issue come november elections.....

    Any ways I guess being positive would be the best approach for us...who cares what the law maker's real motivation is aslong as we get a legislation that's favorable to us...Njoy

    My wife is apply for AP renewal. She has her AParole until oct, 2,2008. She is travelling to india this week for three weeks. Can she apply for renewal and travel to india. Is it legal or does it have any replications.

    1. Did you get already your GC approved?
    Yes

    2. I think you DO need PD to be current for GC approval. In best case scenario, GC could be approved in matter of 10-15 days, so for July filers there were some GC numbers available, and few lucky ones got their approvals. This is how I see it... please correct me if I'm wrong.
    I thought the same too, and I think it was the incredibly rare exception - I must have been assigned a visa number VERY quickly and probably benefited from the confusion at the agencies in the summer. AOS applied early June, FP was completed early July, and I am lucky to have a pretty unusual name. My PD was April 04, my card was received before the DC rally - Visa Bulletin for my category was Aug 02 at the time of approval... .

    3. It would be interesting if shimul99 would share with us as when exactly his status was adjudicated. I've read somewhere that there are cases, that people got their GCs approved by mistake and lawyers suggested to inform CIS and return the GC. These people were then having their statuses adjudicated when their PDs were becoming current.

    Sorry - I missed these questions...

    The system is unfair and broken. Just because I benefited from the current system, doesn't make that statement false

    we have professional lobbyists. and they cost the erath.
    and that is why we need contributions. as long people "don't believe" we don't succeed. it's up to you, it's your issue as much as mine. professionals cost a lot of money, and this thread is quibbling over 20 and 50 bucks. anyway who is the knight on the white horse coming to rescue us? it's just us buddy, and we have to do our best. i like your analytical thinking. we need you to join in and help. any number of volunteers is less imho...

    .....if ppl want to contribute lesser amounts all they need to do is find some like minded friends pooling their resources and making it into a big one time contribution. I have tried to convince some of guys I know over here but to no avail....less said the better...also tried using the charm of a good bottle of scotch to do the job...no good.....but we need to keep trying......bickering will not lead us anywhere....

    There is one more option for you. H1 and L1 employees can go on long paid/unpaid leaves. If her company can support with document that she was on an unpaid leave for any reason (I do not know the reasons...make something) then there are chances that she will be able to change her status back to H4. All you have to prove that there was a good faith employee employer relationship for that particular duration. Talk to a lawyer, explain the situation..........every passing day is making your situation worse. Good Luck.

    It may work for someone who is out of status for couple of months, but if someone has not worked at all or out of status > 6 months, it will be tough.

    Another thing if change of status is approved without I-94 and by then if I-485 is filed, then out of status is recorded and will be very difficult to overcome. It is always better if out of status issue is resolved BEFORE filing for I-485. Typically Change of Status can take 3-4 months and we may not have that much time to wait for I-485.

    Trip overseas and re-entry can fix the out of status issue in couple of weeks.

    Your choice.

    How many of those 245(i) cases from April 2001 might exist in the EB3-India bucket?

    From what I read on some of these forums, there could be 8-10 million 245(i) cases in all, filed on or shortly after April 2001. Were these filed as EB cases???

    IFF this is the case, then EB3-India will likely keep going back and forth between April 2001 and December 2001 for the next several years. Though it doesn't make any sense how EB3-China and EB3-Mexico made it to 2003.

    I agree with all most all of your points except one. You talk about everybody being part of Core IV when you say "Now coming to your question about core team. Core team is nothing but people like you."

    That simply cannot happen because then IV as a whole would be acting like a headless chicken. Everyone now a days seems to be starting a drive, throwing tantrums at fellow IVians etc. This has to stop as per most of passive members, it means directionlessness.

    I've a suggestion. Let's ask our members, those who want to be the core. Let's restrict the core group membership to 20-25. If we get more responses, we can poll for the most favorite candidates on the forum. Similarly we can ask all of our members for the drives they want to support and poll for the drives. The most favorite five drives then become IV's drives. Most people will not work unless they are given clear instructions. The reason FOIA drive became successful was because it was coordinated well, gave a clear direction to the members and had a clear goal. That is why we raised more money than required for that drive. We need similar type of purposeful drives which will keep all of us motivated. The forum members may vote out a core team member, if they are dissatisfied, I mean we can employ all types of checks and balances for an efficient core team and an efficient drive system.

    A ship can have thousands of oarsmen but it needs an able captain to take it to the shore. If you ask me, I'll vote for you as the captain. :)

    Sorry to hear that your 485 is denied....

    My question to all the gurus here...I wonder what happens to EAD and AP after you appeal 485 denial?
    I know that if your 485 gets denied then EAD and AP are void but lets say OP files 485 MTR(motion to reopen), does he have to reapply for EAD and AP or does that get reinstated based on the reciept he gets on 485 MTR?
    Should the person stop working till he gets 485 MTR receipt or till he reapplies for new EAD and gets the approval?
    Just curoius to know as these days denials seems to be the trend at USCIS and it would be helpful for all those who rely on EAD only and not sure what to do when there is a 485 denials for what ever reason.

    FYI...I am still maintaining my H1 and also have a EAD but plan to switch to EAD only and not renew my H1 this year.

    I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.

    I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.

    My PD has been current quite a few times since 06/2007. Last time when I called TSC, my NC was still pending. My FP was done during 07/07 and I heard from some one in this thread that FP is valid for 15 months only. So what should I do now. Should I go for an infopass and take an FP appointment ? Guys please advise.

    This is the third time an Indian American has won the competition in a row.

    BTW, the huge number of Indian American partcipants is not due to the fact that " Indian Americans" are brilliant... These children (at least most) are partcipating not becasue they have talent but they are being forced to by the aspirations of their parents.

    All the Indian American children are crying, sitting on the lap of their parents etc... See any other kid who lost, they were cool.

    Maybe your parents did not hug you enough when you were growing up, but that's not a justifiable reason to be jealous from these kids.

    We are all born as genius, life de-genius us. Each one of us have the ability to be brilliant, it just depends how each one of us chose to spend our time. Folks who spend their time constructively are brilliant, because they have learned to ignore the negative. That's why these kids are brilliant and that's why they have the talent.

    A growing child with aspirations looking for a parent to comfort and console them is not a sign of weakness, its a sign of a strong bond between the child and the parent, I guess thats a cultural thing. And a strong bond with parents that takes away nothing from them for being recognized for their talent.

    As far as being forced by parents is concerned, I know for fact that I would have NOT gone to University to get a degree if my parents were not there to guide me at that age. If parents use constructive guidance that allows the children to strive and become better citizens of the society, that's called "personal responsibility". Last time I check, someone became the President of this country speaking in favor of "personal responsibility" and "responsibility of parents". Was that wrong?

Due to the fact that beneficiary of the For I140 was found to be �unqualified� at the time of filing you are not eligible for relied under section 106� of AC21.

    Is there a possibility that your previous company revoked the I140 saying that they wrongly filed your 140 and that you were not qualified based upon the labor certificate? I hope 180 days had passed after 140 approval. A little more detail on the case will be appreciated. Was it a case of substituted labor?

    First try to figure out what the previous company has done.
    Get the help of your attorney ASAP. Figure out if there is a way to undo the damage.
    I am not very sure of the details, a person I used to know was forced to join his previous company because they threatened him in similar lines.
    & please do keep us informed along the way. We may be able to be of assistance to you in some way or the other. Local IV chapters have access to local Congressmen etc.

    If nothing works go kick the ass of the person who is responsible for your predicament. Interpret kick ass to more severe alternatives. Some companies are anyway taking advantage of people stuck in GC queue. On top of that if they harm us they need to pay a heavy price.

    I work for Fortune 100 company and we are celebrating Diwali on Friday. There are flyers on all the corners and are expecting more than 500 co-workers for pot-luck lunch. And the best part, organizer and main activists are non-Indian. So its just another festival in the mix that everybody is looking to enjoy. This is our first gathering followed by 4-5 more before end of the year.

    Yes, American society is a cosmopolitian society and every culture is respected. Thats why it is called a melting pot.

    The only way we can achieve unity is through social greets and making everyone get a feeling of togetherness.
