Thanks to everyone who has contributed so far. You contribution not only helps the efforts, it is also an indication of the magnitude of the problem.
Please remember to ask your other H1B friends to sign up and convince them to contribute. One person can only contribute so much but one can always ask co-workers and friends to sign up. Even those who are in their 2nd or 3rd year of H1 and have just started GC should be considered as people who will benefit from this effort. They may not realize it now, but sooner or later they would.
Download the flyer from "Resources" menu and spend an afternoon outside local indian temple or indian grocery store. Ask people to take a copy and politely say "this is for information...I am not selling you anything" -- so that they dont discard it away and at least read it. Many of people either dont know about retrogression or dont know about immigration voice that is acting to curb retrogression and labor backlogs. Out of 500,000, if we can reach 10%, its still 50,000. With 50,000 members, the possibilites of what we can achieve is sending 10,000 volts thru my spine.

You should fill out a form with the Ombudsman. Just google for it. They should help you with your case.
Is your NC cleared? Have you taken an infopass to confirm your biometrics and NC is all clear? There have been cases where fingerprinting was done but it wasn't reflected in the case status.
I was very disappointed at infopass five months ago for 140. The person did not even know the difference between EB2 and EB3. So, I am reluctant to waste any further time. My job keeps me traveling out of town 3 days a week.
Fingerprinting for my EAD was in June08, spouse and daughter in Sep07. Is there a separate Biometrics required for 485? How do I find out about NC clearance? Thanks for your help.

Well we desis can only follow the lead of firingis.. so firingis say that who the f*** asked you to come here in the first place and we understand their logic and tell ourselves who the f*** asked us to be here in the first place .. so we are to blame ourselves for everything and take the crap anyway..
But that is not the point.
The point is that me and my company and you and your organisation have paid a service fee with a reasonable expectation of service. reasonable expectation of service is subject to interpretetion based on common sense and no f**king common sense says that waiting 10 years for GC is reasonable .. unless your common sense has been replaced by self disrepecting logic ....
i am not a lawyer but i think that when you pay a processing fees to apply for a privilege (drivers license, business permit, visa, green card etc) from the appropriate statutory authority (DMV, USCIS, Dept of Commerce etc) - the payment of fees does not make you the customer of the statutory authority - so to the extent that USCIS has not broken a law to discriminate against a particular set of applicants (class) - a class action may indeed have no merit.
However, if it can be proved that there has indeed been gross negligence or that USCIS has not followed its own established procedures, made commitments but not honored those, lied or broken the law of the land - then there may be a case.......
another angle is that if the law itself violates the constitution - there is a separate procedure to appeal against such a law (like may suits going on in state courts on laws related to gay rights) - however USCIS would not be party to such a lawsuit since USCIS does not make laws. one would need not only a good immigration lawyer but also a constitutional expert for a venture like this.

In its note http://www.uscis.gov/files/pressrelease/VisaBulletin2Jul07.pdf, the USCIS clearly says it would reject applications starting 7/2. So, how can it accept July applications--especially when many of them haven't been sent yet?

Lets support this bill, there is a website I am trying to remeber the address, I heard while driving on kfyi radio station, where all the bills are listed and people can poll on bills and this will help the lawmakers to find what bill is popular and which one is not.
I'll try to find and post it on the forum, we can poll and support this bill.

I know EB / India would be disappointed but somehow it seems that this is a genuine bulletin - the reason is that family category dates have moved. I wish USCIS would have a exact date when they would release their bulletin

Knowing about future, or predicting what is to come, would help if we ought to do something in preparation; an advance action, such as nailing our windows shut if we are predicting a storm. That is not the case here. Therefore, sure shot 'prediction' is just to wait and see. It is only a few days away. If new cutoff date encompasses your PD, pray and check your email every day (or every hour or even minute), and hope for the best.
I agree with you. Next week we will see the bulletin and then some people will be elated if their predictions come right and some will be disapointed. Again in 20 days we will start a new thread for Oct bulletin and FY 2010. I guess it is just that we are keeping alive our hopes.

Can we get License renewed using EAD and not having H1?.
Driver's licenses are issued by state and governed by state laws and regulations. Check your state DMV and find out.
In about 12 states, even illegals can obtain driver's licenses. However, most states are tightening rules and need to see your I-94 to prove your legal presence.
EAD is for work authorization and doesnt prove legal presence. Legal presence is proved by I-94. Regardless of how you enter into USA, with H1 stamp or with AP, you will have an I-94.
In any case, check your DMV.

For them "God" is the one that has created this world , for you its nature that has created this world.

I hope you get in time before your EAD expires. My EAD was expiring on 09/24 and my employer submitted on June 24 (no efiling) & RD dt June 24; Got my EAD approval email on 07/28 and card received on 08/01/2008; but renewed EAD runs from 7/30 - 7/29/2010; I did not mind the disappearance of 2 months. Which service center did you apply

One big missing piece in your analysis - Country quota.
As per your analysis, there are around 125K pending cases. If there is no spill over (that is the case this year and that will be the case for the coming years as per State dept.), then EB3-I or EB2-I gets only 2700 visas per year.
Now, please redo your math and you can easily see that the current retrogress might look like there is hardly any retrogression.
This is my thought process (also referred by Ron G):
July 2007 brought in approximately 500K 485 cases.
We do not know how many cases were pending as of June 2007.
Fiscal year 2007-2008 USCIS used over 140K EB VISA numbers (I think it was around 155K).
Fiscal year 2008-2009 USCIS will use atleast 140K EB VISA numbers
so, 500K - 300K = 200K.
Assuming USICS approval rate is 85%; 75K of 500K are denied.
200K - 75K = 125K EB cases pending from the July 2007 cases.
Additions: from all current categories - may be 25 K in 2 years?
So, 150 K plus whatever that was pending as of June 2007.
So next fiscal year, 2009 if USCIS uses the quota 140 K, most or all of the 2007 filings will be cleared. If not EB3 I, definitely EB2 I and C, EB3 ROW will be cleared.
Depending on new filings, EB3 I might retrogress but retrogression might come within 3-4 years instead of current 8 years.
I strongly believe, beginning Jan 2010, dates for EB2 (I and C) will move forward heaps and bounds followed by EB3 ROW.
