    Just out of curiosity how many of those 60% were citizens? I know a lot of friends who have put in extra 5 years to get the citizenship.

    I think aging parents is probably the biggest and valid concern a lot of ppl have.
    I think there are plenty of people who always planned to go back .. the GC /USC was just a career advancement tool for these people. In fact, a survey of US returnees to India after 2000 shows that the majority (around 60%) were USCs/ GC holders, which is clearly an indication that the relocation was by choice rather than any immigration issues.

    And finally, many of us have family issues like taking care of aged parents which either makes the re-location inevitable or in some cases may coincide with career goals.


    I have seen that most ppl who have been here for over 5 years have almost fallen in love with the possibilities. They talk about going back to take advantage of the booming growth but very few actually do go back.


    Or maybe some of us came here precisely for the reasons you mention, seeking greener pastures but fell in love with the openness, informality and the possibilities here .

    I am shocked too. 2 members who I called on phone were abusive. They started blaming Aman Kapoor saying that he is rubbing his idealogies over already stressed immigrants - this was ridiculous and I am so sad that people have such thoughts.

    If people are scared or want to live in Shadows why abuse IV who are truly committed for a cause???? These are the same people writing rubbish on those threads that ran 200 pages when they were waiting for USCIS announcement.

    Singsa - u r doing a great job. Lets be persistant with the fact sheet.

    Let people say what they want to say. Every big effort will have people who will have difference of opinion. The work needs to go on and only then it will benefit the community. If we stop this work because someone is upset or feels that GC is not a big deal for them, then it will not help anyone, but hurt this cause. If someone has concerns then they should contact us or come to DC for the rally and meet us. We will talk to you and answer questions you may have.

    Recently I returned after a one month trip to India. At DC airport the CBP secondary inspection officer grilled us rough. First he called my wife and asked why did we leave US. She told that since my parents are old and not in good health we visited them. Then he started asking for documents proving it. And told us that without documents he won't let us enter. He went on to say that AP is only on humanitarian basis and unless CBP officer is satisfied with proof they cannot allow AP holder to enter. Finally after convincing him for another 30 min he let us in.
    This was a really shocking experience. Are employment based GC's AP supposed to be treated like humanitarian AP? or was the CBP officer over reacting? Gurus please throw some light.

    I have used AP at least 4 times this year while coming back from Europe,India.I came through New York(JFK),Newark(EWR). Only once I was asked a question about whether I have EAD. The officer didn't even see it,otherwise the only exchage with any other officer was 'Here are your documents.Have a nice day'.
    I think you might have been a one off case where the officer didnt know what he was doing.

    Intresting someone brought up Gandhi's name here, we just'nt could manage more than few hundred to get togather to raise one voice, I just wonder if I think how this person was able to inspire millions to march on street and follow him without any questions asked.

    back to topic, dude if you want you can go back there are many here who are counting on guys like you who will return so that their line gets shorter, we just go the way wind blows seems like itz going strong towards east these days

    Probably your lawyer is correct that you cannot take advantage of family leave (maternity act) with less number of employees in the company than required for that.

    From what I understand about H1-B, you CAN take leave without pay - no problem with that...as long as you are on your company payroll i.e. your employement is not terminated.

    Does any of you know what rights for maternity leave has a pregnant H1B visa holder? I want to stay home next year for 3 months to take care of my baby, then start working again.
    From what I know I can only have the 6 weeks of short term disability.
    The Maternity Act does not apply in my case because the company I'm working for has under 50 employees.
    I asked my lawyer if I can take any unpaid leave without loosing my H1B status and her answer was that I can change my visa to H4 or become a part time employee for a while. I do not like any of this options because I'm in my I140 stage with my green card and I do not want to lose it at this stage, after waiting for years to get my labor cert approval.
    Your answer would be appreciated.

    I dont think USCIS is thinking that way. They are just picking a stack of application ( mix of all EB1 2 3 for all nationalities) and validating the applications to see if anything is missing or if there are potential reasons to deny it. If they can deny it they will do it promptly and that is one less case to be shown as pending. If they need additional info they will issue RFE and get updates. If they feel satisfied they can pre-adjudicate application and claim that count in their yearly review as acheivement.

    Preadjudication is done to maximize visa utilization and avoid rapid movement of dates. DOS moved dates in July 2007 to maximize visa utilization keeping CP applicants in mind, but did not have a count of AOS applicants.

    But the fact with EB is most applicants are AOS as compared to CP.

    By preadjudicating they are able to have a count upfront to hit the CPO trigger.

    Now when your dates become current, the officer may want to review your situation again or may not - this is pure speculation and is a possibility.

    How bad it can be for those with approved I-140?
    Earlier it was 140K times 7% = 9800 with everybody and now it is 90K times 10% = 9000 with most of them gone into new merit based system.
    I still don't get it?

    Good Point! this is actually more visas for same number of folks. Approved or soon-to-be-approved I-140 folks (like me) will get GC on time or faster and others with Maters degree will get GC in 1 or 2 years, and rest must have got admission to MS by now. and there will be some loophole to bank on which will be realized by our stupid Joe after a few years.

    our immigration department told me that as per USCIS regulation they can not apply earlier than 6 month of expiry date

    Strange...

    Apply on the date your 6 months are left. Use the couple of months before that to follow up with your employer and Lawyer and get all paperwork done and application packet ready. If lawyer or the employer is slow, then one needs to push them since ultimately you are going to be affected and nobody else.

    The onus is on the H1B worker to be diligent and not leave everything to the last few months. DMV is only following the rules. Maybe some of them are not aware of the rules. The issue of not getting license despite H1B approvals, and H4s not getting DL is something one can take up as an issue with media and authorities. But just because the person did not bother to get the H1B extended until the last moment cannot be an excuse for relief when we approach the authorities.

    Good point , but neither H1B says its only for INNOVATORS rather it says only SKILLED workers. Not even every PhD is innovator . May be in some circumstances the so said perspective is true but i dont agree with every point.

    There are no enough Americans who can do the Job if you guys think its H1B and remove H1B every Job will land as an outsourcing . If not h1B many Outsourcing IT firms will find some way to temp bring IT pros and eventually outsource.

    The Key point that IV is making is how much taxes we are paying and how good we are making to American economy. If they remove H1B ,then they understand how and what they have lost.

    Good points, only thing to add is not all innovations can be brought to notice to relate to a sinle employee ...most of the times we as employees are part of systemic effort that is innovating. It would be wrong to say that H1-bs are not contributing towards innovation anymore.

    Labor is done via perm process and they are now centrally processed (only prevailing wage is state dependent). Your company can apply for it online and you should get a result in 3-4 wks if the case is not audited. Good Luck to you.

    Having dealt with Americans in the past 8 years, I don't believe they planted evil designs in the current immigration systems just to get the best of us. The problem here is that people in this country have a very strong and almost unstoppable tendency to complicate things. Immigration system is one obvious example. PD date, quota, and ROW, millions of different forms etc. Its complexity is simply beyond you and me. Other examples abound. Legal system, taxation, state / federal relations, college admission, business dealing, etc. Once you reach teenage stage, there is no way you will ever live outside these sytems.

    So why is this? First of all, Americans believe in fair and equal dealings between each others. Then natually they set up millions of rules / systems to even the play ground. Secondly, a complicate system is a lazy man's product. It's not a big deal if you can design a extremely complicated and all inclusive system. What's great is that you can make it simple and intuitive so even your grandma can use it, while at the same time it covers all objectives & purposes served by the complicated system.

    My issue with this way of working is that the more complicated the system is, the more likely it will fail. Look at the space shuttle. Each of the one million parts was probably checked, double, and triple, and quandriply re-checked, but you put them together into the shuttle itself, you still got two space disasters in the past 20 years.

    Another consequence of this social pattern is that systems most often get exploited by people armed with specialty knowledge. I guess everyone here paid the lawyers (or your sponsor paid). Same thing for the accountants. These specialists are taking advantage of the fact that ordinary people can not get a handle of the current situations and have to ask for help.

    I agree that it's really a personal choice. It's quite risky in this economy with housing prices going down. It needs a lot of reasearch and lot of thinking before you can make that decision. I don't think surveying people will help because there's lots of personal factors that can play a role in making that decision. Maybe it may help to listen to different people's decision making process. Having GC is a factor but it's not the only limiting factor. I know a lot of people who bought homes much before they filed the i-485 and i know few others who didn't and you can't blame them for their decisions.

    For the record, i bought my home in 2008 and i must admit that owning a home is one of the nicer things i did in this country. We and the kids love the extra space and the luxury. My kids will be going to public school next year so will be making full use of the taxes we pay.

    If you have a stable job, IMO you can buy a home and i bet you won't regret that decision. But stable job is as hard as finding a treasure these days.

    Guys,
    Thats what my Question is......how i am gonna prove it i paid 3k for my H1. They are deducting 500 (for my H1) everymonth from my paycheck in the name of CASH ADVANCE DEDUCTION.
    I really want to teach them a lesson....so that they stop messing many vulenerable people like me who go to them every year. Could somebody tell me how i am gonna complain DOL in new jersey about this company and does DOL really takes any action.
    Greencard is not i am much looking for......i am planning to go back to india after 2-3 years.

    Here is the starting point. One way to do this to start from 'Wage & Hour Division' of US DOL. In NJ, this could be reported to the district office of US DOL at the following contact information.

    Will soon post specific regulation that says your employer cannot deduct H1 fee from your paycheck. Although, no one is going to dispute that, it is always good to keep it available to show it to DOL officer to put additional weight in your conversation, so that DOL officer knows that you have done your research and know the rules and regulations.

    Also, DOL will tell you to file WH-4 form. They will assure you that you identity will will kept confidential. So you will never have to tell your employer that you are the one you cmplaint. They will simply plan a visit to your employer's office and summon all the records. And the truth will be know.

    am not able to be there these days as I am travelling for work during this time. Also, I have 10k United miles with me, and I would be more than happy to donate it to someone who can travel. But I am not sure if 10k is enough for a round trip. If some one has any inputs on this, I am happy to be of some use at atleast by giving away these miles.
